A town-level conditional use permit is needed for all
ponds. This does not replace Shawano
County pond permit requirements.

The Town of Angelica Board of Supervisors, Shawano County, Wisconsin, ordains as follows:
1.01 Title...Development Standards and Requirements for Ponds
1.02 Purpose...In order to promote the public safety and general welfare, it is necessary that certain uniform standards and requirements be established and followed in the construction of ponds in the Town of Angelica.
1.03 Statutory Authority...This ordinance is adopted as authorized under s.61.34(1) Wis. Stats. and the Town of Angelica having obtained Village Powers from its electorate on April 1, 1958, which resolution was ratified by a resolution approved by the electorate on April 8, 2003.
1.04 Abrogation and Greater Restrictions...It is not intended by this ordinance to repeal, abrogate, annul, impair or interfere with any rules, regulations, ordinances or permits previously adopted or issued pursuant to law. However, whenever this ordinance imposes greater restrictions, the provisions of this ordinance shall apply.
1.05 Severability...Should any portion of this ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected.
1.06 Applicability...The requirements of this ordinance apply to all persons within the Town of Angelica.
1.07 Administration...The provisions of this ordinance shall be administered by the Town of Angelica Board of Supervisors or its designee.
1.08 Town Conditional Use Permit Required... Before any pond can be constructed in the Town of Angelica, approval must be granted in the form of a town conditional use permit. The request for this conditional use permit is to be reviewed by the Town of Angelica Planning Commission, which Commission will forward a recommendation for approval or denial of the request to the Town of Angelica Board of Supervisors.

1.11 Exemptions...
a. Ponds one hundred square feet (100 sq. ft.) or less in size, as measured around the perimeter, shall be exempt from this ordinance.
b. Ponds constructed as a fish or wildlife facility shall be exempt from this ordinance if they conform to the appropriate technical standards administered by the USDA Natural Resources Conservation Service or the U.S. Fish & Wildlife Service.
1.12 Penalties...If any pond is constructed in violation of the provisions of this ordinance, the Town may restore the area to a condition which complies with this ordinance, and recover the cost from the responsible party. The penalty for violation of any provision of this ordinance shall be a forfeiture of not less than $75.00, nor more than $200.00 together with the actual costs of prosecution, including attorney fees and court costs. Each day of continuing violation shall constitute a separated offense.
1.13 Effective Date...The provisions of this ordinance shall take effect on May 14, 2007, upon passage and publication as provided by law.
