Town of Angelica Committee Present: Chairman Richard Ferfecki, Secretary Connie Nischke, Ron Hinkfuss, Barb McKeefry and Dwayne Splan.

The meeting of the Town of Angelica Planning Committee was called to order on July 6, 2010 at 7:00 p.m. by Chairman Richard Ferfecki. The Pledge of Alliance was said. The Chairman verified with the Secretary of the Committee that notice of the meeting agenda had been posted properly.
Request #1 CU-3-10. Greg Manci request a conditional use permit for a non-metallic mining operation to remove sand on approximately 2.6 acre area that covers 3 parcels on W525 Townline Road by Krakow, Wisconsin.
Legal Description: Parcel #004-02010-0001, 004-02010-0000 & 004-02010-0003, Lot 3,2, & 4 CSM 3078, Sec. 2, T26N, R18E.
Conditions for the non-metallic mining operation will be the same as for any other in the Town of Angelica including a road bond . It is recommended that Mr. Manci and the Town of Angelica take pictures of the current road condition as proof of the state the road is in now. Spot inspections by the Town can be done at any time.
Conditions
for CU-3-10:
1. The excavation of sand from the property to be as indicated on the drawings/aerial photos provided.
2. The driveway should be graveled with crushed rock.
3. Land reclamation plan needs to be done and followed from East Central Planning or another similar agency. (Topsoil replaced, etc.). The plan must address the issue of the land so to can be used again for agricultural purposes.
4. Hours of pit operation will be from 7:00 am to 6:00 pm. Monday thru Friday and 7:00 am to 12:00 pm on Saturday. The operation is to be closed on Sundays and holidays.
5. Trucks delivering sand from this pit will not go through the Village of Krakow to access State Hwy. 32 except in cases where the sand would be delivered to a property owner in Krakow.
6. The sand excavation/removal operation is to be conducted in such a manner so as to avoid any damage or nuisance affect to adjacent property and/or structures.
7. Maximum Depth of the non-metallic mine is to be no greater than 30’.
8. Side slopes of the pit area not to exceed 4’ (horizontal) to 1’ vertical.
9. Operation of the mining operation to comply with provisions of Section 24.07 (7) of the Shawano County Zoning Ordinance No. 102, including minimum setbacks from the property lines and single-family dwellings.
10. There will be no blasting of materials involved with the quarry operation.
11. This permit will expire in 5 years at which time applicant may appear before the committee to request a 3 year extension.
12. The committee may at any time, amend or add conditions to this permit approval to ensure compliance with all legal requirements.
13. A bond of $5000 shall be put up to help cover road repair in the future per Town Ordinance 5-11-09 (Page 31 paragraph 3 on the Town of Angelica Comprehensive Plan).
14. Planning & Development Department Staff shall be allowed access to the property to perform onsite inspections to ensure compliance with the above conditions.
Barb McKeefry made the motion to grant a 5 year permit for the non-metallic mining operation (CU-3-10), Dwayne Splan seconded the motion. No one was present to oppose the request. A neighbor did submit a written letter stating he was OK with the project. The motion passed unanimously.
Request #2: V-1-10 John Jacobs IV request a variance for a home dwelling to be 610’ from the right-of-way on Beech Road, Pulaski, WI where 290’ is the maximum setback
Legal Description: 004-05430-0000. S.W. ¼, S.E. 1’4, Sec. 5, T26N, R18E. Town of Angelica, Shawano County, Wisconsin. 40 acres.
John Jacobs IV was present to ask for a variance to place a home 610’ from the right-of-way of Beech Road. A previous dwelling located on this parcel in this area burned down. There is an existing mound system, drilled well, and electric service in this area, so construction of a new home in this area could utilize this. This proposed home location is currently not being farmed. John wants to obtain a variance to allow him to create a parcel (less than 35 acres) with the home 610’ from right-of-way. Driveway should be 15’ so fire and rescue have access. No one was present to oppose of the request.
Barb McKeefry made the motion to grant a variance for John Jacobs IV, Connie Nischke seconded the motion. The motion passed unanimously.
Request #3:V-2-10 Doug Splan request a variance to allow existing residence and associated out building to be separated from the parent parcel where the residence will be in excess of 290’ from the road right-of-way.

Doug Splan was present to ask for a variance to have his existing residence and associated out buildings to be a separate parcel per a letter from his bank (Bank of America) for refinancing issues. The bank letter states that the private mortgage insurance company will allow a maximum amount of 5 acres.
The banking industry has had many changes within the past few years and property values of dropped, therefor the need for the bank to have him ask for the variance.
Ron Hinkfuss made the motion to grant the variance, Barb McKeefry seconded the motion. The motion carried.
Public Meeting
The meeting of the Angelica Planning Committee was called to order immediately following the Public Hearing by Chairman Richard Ferfecki at 8:55 p.m. The Chairman verified with the Secretary that the notice of the meeting and agenda had been posted properly.
A motion was made by McKeefry and seconded by Splan to approve of the April 8, 2010 minutes. The motion carried unanimously.
Discussion was held of County Zoning Meetings and status of the County Plan.
A motion was made by Ferfecki and seconded by Nischke to adjourn the meeting. The motion passed unanimously at 9:00 p.m. The next meeting will be August 3, 2010 unless no action is needed.
