Call to Order/Roll
Call/Verification of Meeting Notice: Chairman Smith called the meeting to order at
6:35 p.m. followed by the Pledge of Allegiance. All officers were present for Roll Call. Smith verified with Clerk Powers that proper
posting of the meeting had been done.
MOTION
(Powers/Lewis/PASSED) to deviate from the meeting’s agenda and take up New
Business Item a. at this time.
a. A copy of the request made by the Krakow
Sanitary District No. 1 to add territory to the Krakow Sanitary District No. 1,
and to correct a description of territory added by Order of the Town Board of
the Town of Angelica on December 8, 2004 had been presented to the board. The request was submitted by Krakow Sanitary
District No. 1, and was made pursuant to Section 60.785 of the Wisconsin
Statutes. Following the procedures in
Section 60.71, the Town Board of the Town of Angelica scheduled a hearing on
said request. A Notice of Public
Hearing was published as a Class 2 notice in the Shawano Leader, the official
newspaper of the Town of Angelica, and Notice was mailed to the Department of
Commerce and the Department of Natural Resources at least ten days prior to the
hearing. Notice was also provided to
the Town Board Chairman of the Town of Chase.
The public hearing was conducted on August 8, 2005 at 6:15 p.m. at the
Town of Angelica Town Hall. All persons
who wished to address the Board were given an opportunity to do so. One property owner located in the Krakow
Sanitary District was present at the meeting.
Attorney Liebmann and Krakow Sanitary District President Jim Lotter
explained that the Oconto County Register of Deeds had discovered errors in the
original description of the area to be annexed to the Krakow Sanitary District
and the errors were a typographical error and an error because an exchange of property
was not recorded resulting in an incorrect description being drawn up. MOTION (Lewis/Powers/PASSED UNANIMOUSLY
BY VOICE VOTE) to add territory and correct a description in the Town of
Chase to the Krakow Sanitary District No. 1 as Findings had shown and to
approve an Order correcting description and adding territory to the Krakow
Sanitary District No. 1, both as drafted by Attorney Liebmann. The written Findings and Order correcting
description and adding territory to the Krakow Sanitary District No. 1 are
being made a part of this meeting’s minutes.
The town board then returned to its agenda as
presented.
Approval of Prior Town Board Minutes: MOTION (Powers/Lewis/PASSED) to accept the minutes
of the regular town board meeting of July 11, 2005, and special town board
meetings of July 13, 2005 and July 28, 2005 as presented by the Clerk.
Approval of Treasurer’s Monthly Report: The
Treasurer’s report was presented to the board by Treasurer Matuszak showing
balances as of July 31, 2005 of $201,006.90
at the Citizens Bank in Pulaski, $170,494.14 at the Premier Bank in Pulaski and
that CD#45270840018 in the amount of $61,659.56 was renewed for a ninety-day
period at a rate of 3.65 per cent with the provision that one withdrawal could
be made during this period without penalty.
MOTION (Powers/Lewis/PASSED) to approve the Treasurer’s report as
presented. MOTION
(Lewis/Powers/PASSED) to delete check nos. 6839, 6232, 8234, 8429, 8529 and
8581 totaling $117.22 from the town’s disbursements by issuing a receipt for
this same amount. (These checks were issued in
2001 thru April of 2004 and were never cashed).
Correspondence: Correspondence
reviewed was (1) CSM for 1 lot on Elm Road (2) copies of Wetland Federal Water
Quality Control Permits issued by the DNR to Joe Lilla, Jr. and the Krakow
Sanitary District No. 1 (3) copy of Shawano County Floodplain Ordinance that
was adopted by the Shawano County Board on July 27, 2005 (4) copies of 3
land-use permits issued by Shawano County for property in the Town of Angelica
(5) notices of meetings of Shawano County PD&Z, Board of Adjustment and
Land Conservation committees (6) Krakow Sanitary District July 2005 newsletter,
and (7) notices from Wisconsin Towns Association and UW-Extension regarding upcoming
seminars, workshops and teleconference workshops.
Reports from Town
Officers: Supervisor Lewis reported he had received a
complaint from Joel Jarock regarding
the way his driveway was left after recent road reconstruction. Joel Jarock also said that the driveway
culvert for Jeff Jarock was changed from the 18 inch culvert that was
originally installed to a 14 inch culvert.
Chairman Smith indicated that he would check into this. Supervisor Powers reported on installation
of 911 numbers during the past month.
Chairman Smith reported that he had just received permits for the road
reconstruction work from the D.N.R. that he had been working on for the past
two months. Smith also stated that he
would like to start on selecting roads that will be reconstructed in 2006 this
fall and next year when the on-site meeting is held ask both the electric
company, telephone company and gas company, if involved, to be at the on-site
meeting. Smith reported on a July 24th
meeting of the N.E.W. Para-Medic Rescue board and said the 1st
Responder program is up and running and
insurance has been approved. The new
Auto Pulse unit recently purchased for the rescue squad has already saved one
life and up to July 14th there have been 190 rescue calls. Clerk Powers reported on attendance at a
State Elections Board meeting and upcoming required training for clerks and
chief election officials.
Report from Planning
Committee Chairman: Town of Angelica Planning Committee Chairman Richard
Ferfecki reported on approval of a CSM for Lee DuChateau and attendance at the
August 3rd County PD&Z Committee meeting at which the non-metallic mining request of Joe Lilla
was approved. The Committee had
questioned the installation of a concrete wall and no pumping of water off
premises, but they were included in conditions put on the permit. Ferfecki also brought to the board’s
attention a possible problem in the subdividing of a 44-acre parcel on Willow
Road.
Public Comments: Elmer Kraning asked about what should be done about several large tires he picked up in a town ditch on Middle Drive near Elm Road and said that some of the tires appeared to be in good condition. Wilbert Lewis offered to check out the possibility of Pomps using the tires for retreading. MOTION (Powers/Lewis/PASSED) to put an ad in both the Hometown Shopper and the Pulaski News asking town residents to be watchful for people dumping in town ditches and offering a reward of $200.00 if a person doing this was found and convicted. Chairman Smith asked Kraning to take care of the branches obscuring the stop sign by the church in Zachow and also the stop sign at Beech and County F and to take care of a road sign that is down at Deer Drive and STH-32. It was also pointed out that there is a large dead elm tree near Walter Bohm’s property that could fall onto the road and power lines during a storm. The Clerk was instructed to draft a letter to the power company asking for removal of the tree.
Specific Matters for
Discussion and Possible Action by Town Board in Open Session:
a. The request from the Krakow Sanitary District was
addressed earlier in this meeting.
b. MOTION (Powers/Lewis/PASSED) to table the agenda item regarding an up-date on the
Krakow Park from the Krakow Advancement Association inasmuch as Steve Effert
was not present at the meeting.
c. An application from Connie L. Pedersen for a
Combination Class B License and Cigarette License at Northwestern Pub in Zachow
to be effective September 1, 2005 was reviewed. The present license for Northwestern Pub held by Steve Sams has
been turned back to the town with an effective date of September 1st. MOTION (Lewis/Powers/PASSED) to grant
a Combination Class B Retail License and Cigarette License to Connie L.
Pedersen effective September 1, 2005.
d. Applications for four operator’s licenses from Megan
M. Naparalla, Meyrn R. Delano, Andy L. Van Den Elzen and Lori J. Pues were
reviewed. MOTION
(Lewis/Powers/PASSED) to grant Operator’s Licenses to the four people
applying.
e. There was discussion regarding a complaint in regard
to noise and litter problems near the grain drying operation on Hilbert Street
in Zachow. Stuart Sorensen and Donald
Staszak were present and explained there had been an unusual circumstance where
a dryer fan had to be running continually for two weeks because of a hot
bin. There was also a question as to
whether or not the “bee’s wings” from corn can be considered to be litter. It was the general consensus to check this
out and bring the complaint up at a future meeting and invite the person who
complained to attend the meeting.
f.
There was discussion
regarding a drainage problem on Elm Road because of the blocking of a man-made
ditch on private property. The general
consensus was to have this be an agenda item for the September meeting and ask
property owners in that area to come to
the meeting and reach an agreement on what can be done to solve the problem.
Specific Town Board
Notice and Agenda for Upcoming Town Board Meeting: The next town board
meeting will be held on the Monday, September 12, 2005.
Voucher Listing/Payment
of Bills: MOTION (Powers/Lewis/PASSED) to approve vouchers No. 2836 through No.2863.
Adjournment: MOTION (Powers/Smith/PASSED) to adjourn the meeting. The meeting was adjourned at 8:30 p.m.
