Monthly Meeting

February 14, 2005

 

 

Town Officials Present: Chairman, Richard Smith, Supervisors, Tom Gwidt and Clifford Powers, Treasurer Lisa Matuszak and Clerk, Janet Powers

Town Officials Absent:     None

Call to Order/Roll Call/Verification of Meeting Notice:  Chairman Smith called the meeting to order at 6:30 p.m. followed by the Pledge of Allegiance.  All officers were present for Roll Call.   Smith verified with Clerk Powers that proper posting of the meeting had been done.  MOTION (GwidtPowers/PASSED) to approve the agenda as presented.

 

Approval of Prior Town Board Minutes:  MOTION (Powers/Gwidt/PASSED) to accept the minutes of the regular town board meeting of January 10, 2005 as presented by the Clerk.

 

Approval of Treasurer’s Monthly Report:  The Treasurer’s report was presented to the board by Treasurer Matuszak showing balances as of January 31, 2005 of  $143,604.19 at the F & M Bank in Pulaski, $645,136.49 at the Premier Bank in Pulaski and CD#45270840018 in the amount of $60,882.69 .   MOTION (Powers/Gwidt//PASSED) to approve the Treasurer’s report as presented. 

 

Correspondence:  Correspondence reviewed was (1) letter received from Patrick Karcz stating his resignation as Town of Angelica Planning Committee Chairman (2) letter from Assured Inspection Services stating no building permits were issued by them for the month of January (3) CSM for an out lot in Section 7 comprising 0.766 acre (4) copy of a letter written by Shawano County Land Use Enforcement Coordinator informing a property owner on Green Valley Road that a conditional use permit for an extension to a permit for non-metallic extraction is required (5) summary of fire protection costs for 2004 from Pulaski Tri-County Fire Department (6) notice from Town of Green Valley Plan Commission regarding an upcoming intergovernmental session on shared services (7) copy of a Utility Easement form between the Town of Angelica and the Krakow Sanitary District that was not completed from Eileen Ripley (8) notice from NWTC regarding upcoming appointments of representatives to their District Board (9) notices of meetings from various Shawano County committees (10) Notice from Public Service Commission of Wisconsin in regard to a application for approval of a Boundary Agreement between Wisconsin Electric Power and Wisconsin Gas Co. and (11) brochure from Vierbicher Associates regarding NR 151 – Stormwater Rules as it affects construction work.

 

 

 

Reports from Town Officers:  Supervisor Cliff Powers reported (1) the County is starting the selection process to appoint a new Shawano County Highway Commissioner and a special committee will be formed to review applicants for this position (2) he attended a Highway Convention in the past month and said that the importance of crack filling roads early when the cracks are not very large was stressed (3) there is an upcoming meeting of the County PD&Z Committee where possible changes to the A-G-1 zoning will be discussed (4) Powers asked if anything has transpired in regard to problems with complaints about treatment of horses, stones in the ditch on Hickory Road and meat found in the ditch on Hickory Road.

 

Clerk Powers reported that Mrs. Ed Kazik had informed her that Ed Kazik has recently undergone two surgeries and is recovering from them now.  Along with the note Mrs. Kazik forwarded a copy of the interest income statement from the F & M Bank regarding interest earned by the Angelica Hillside Cemetery Association.  Clerk Powers also reported that maps had been forwarded to Attorney Rottier of the one mile of Town Hall Drive and one mile of Willow Road the town is planning to reconstruct for the purpose of preparing easements from property owners on these two roads.

 

 

Report from Planning Committee Chairman:  As Chairman Pat Karcz has resigned and no replacement has yet been named, there was no report from the Planning Committee Chairman. 

 

Public Comments:  There were no comments or questions from those in attendance at this time.

 

Specific Matters for Discussion and Possible Action by Town Board in Open Session:

 

a.       Peter Kruit of Assured Inspection Services LLC was present.  Kruit informed the board of the process whereby he entered into a contract with the Wisconsin Department of Commerce to enforce the Uniform Dwelling Code for towns in Shawano County that do not have their own building inspector.  Assured Inspection Services will be issuing UDC permits for new dwellings to be constructed in our town and he will be paid through the permit fees collected, which fees are based upon the square footage of the home..  The UDC Building Permit can be obtained by mail or fax from him and it is not necessary for people to travel to Birnamwood to obtain this permit.  There can be up to ten inspections on a new dwelling.  However a number of these inspections can be combined in one trip.  After he receives a call that the construction is ready for the various inspections, he has forty-eight hours to inspect that construction.

 

b.      Wayne Nighorn of Nutrition Service Company was present and answered questions the board had in regard to his request C-1-05 for a conditional use permit for the operation of a feed mill on property zoned A-G, General Agriculture, located at W149 Deer Drive.  Nighorn presented a site plan and pictures of a facility similar to the one he plans to construct and stated he plans to be in operation by August or September of 2005.  The Town of Angelica Planning Committee recommended to the town board that this request for a conditional use permit be approved with the following conditions: (1) proper septic system must be installed on parcel (2) operation of the feed mill must be conducted in such a manner so as to avoid damage or nuisance to adjacent properties and/or structures (3) operation of the facility must meet all applicable WDNR and DATCP requirements and specifications, including environmental codes relating to noise and dust and (4) the Planning Committee may amend and/or add conditions at any time.  MOTION (Powers/Gwidt/PASSED) to recommend to the Shawano County Planning, Development and Zoning Committee that approval be given to request C-1-05 for a conditional use permit for the operation of a feed mill on property located at W149 Deer Drive as reported on the Decision Form signed by the Planning Committee and Town Board.

 

 

c.       A written complaint from Marvin Staszak and Gregory P. Van Asten had been given the town board in regard to buildings at W280 and W290 Angelica Street in Krakow and concerns about safety, structural problems and being unsightly and bringing down property values of surrounding parcels. It was requested in the complaint letter that these two buildings be inspected by a licensed state building inspector.  It was the general consensus of the board to have Supervisor Gwidt proceed with finding a licensed inspector, determine what the inspection cost might be and report back to the board at the March meeting, at which time a decision would be made as to what direction to take in regard to these buildings.

 

d.      A written complaint by Ken Holewinski, W647 Deer Drive, regarding two dogs running loose and coming on his property where they did damage to his trees and gardens along with pictures of dog excrement on his property had been given to the town board.  The complaint stated that the two black labs were owned by his neighbor, Wilbert Lewis.  Wilbert Lewis was present and said the dogs were not his dogs and he keeps his dogs in the barn.  The clerk was instructed to write a letter to Ken Holewinski and suggest that he get pictures of the dogs when they are on his property or try to catch the dogs, lock them up and then call one of the town board members. 

 

e.       James and Connie Przybylski were present in regard to a bill they received for a fire call response because a call by a passerby was made to 911 saying there was a fire on their property.  The bill was for $190.00 representing 19 members reporting to the fire station.  It was determined that there was only smoke from Przybylski’s wood burning outdoor furnace and the fire engine and trucks were then cancelled.  There was discussion on how billing of false alarm calls should be handled.  MOTION (Powers/Smith/PASSED) that the bill for this fire call be paid by the town.  It was also the general consensus that if false alarms to this property continue because of smoke from the wood burner, the property owner would be asked to find a way to try to eliminate having passersby call in to 911 because they think a building is on fire.  Jim Przybylski said that possibly putting a light on the smoke stacks on the wood burner or the adjacent building could help determine that there was only smoke and no fire in those buildings.

 

f.        Because of the resignation of Pat Karcz as Chairman of the Town of Angelica Planning Committee, Chairman Smith asked Planning Committee Member Richard Ferfecki if he would accept appointment as Chairman of that Committee.  Ferfecki was present and asked if the board could wait one week for him to make a decision regarding accepting that appointment.  Chairman Smith also asked if anyone knew of a person who would be willing to be appointed as a member of the Planning Committee.

 

g.       Applications for Operator’s Licenses from Lorra M. Rowe, Jamie J. Bartels and Rebekah R. Wied were reviewed.  MOTION (Gwidt/Powers/PASSED) to approve the applications for Operator’s Licenses as presented.

 

h.       A draft of a newsletter to go out in early March along with the annual financial report was reviewed.  It was the general consensus to send out the newsletter as drafted and to also add an explanation as to the increase in the town mil rate as compared to the prior two years.

 

 

 

 

 

i.         Chairman Smith reported that the N.E.W. two squads have been painted and were in the area today with personnel visiting the four local hospitals.  In the near future they are planning to visit business places and introduce themselves and also familiarize themselves with local roads.  All personnel hired have their state licenses.  It is also planned to have workshops to encourage more people in the area to be 1st Responders and to have an open house after the start-up date which is March 1

 

 

 

Specific Town Board Notice and Agenda for Upcoming Town Board Meeting:  The next town board meeting will be held one week earlier than usual in March and will be on March 7, 2005 rather than March 14, 2005.  An up date on Harold Blazei’s property will be an agenda item along with the Jim Swiecichowski property as mentioned earlier in these minutes.

 

 

Voucher Listing/Payment of Bills:  MOTION (Gwidt/Powers/PASSED) to approve vouchers No. 2580 through No.2620. 

 

Adjournment: MOTION (Powers/Gwidt/PASSED) to adjourn the meeting.  The meeting was adjourned at 9:45 p.m.
