Special Meeting ~ July 13, 2005

 

Town Officials Present:  Chairman, Richard Smith, Supervisors, Clifford Powers and Wilbert Lewis, and

     Clerk, Janet Powers

Town Officials Absent:  Treasurer, Lisa Matuszak

Others Present:  Town of Angelica Planning Committee Chairman Richard Ferfecki, Joe Lilla, Craig Duchateau

                & Cory Duchateau of DMK, Ken Wall and Jim Mills

           

Town of Angelica Chairman Smith called the meeting to order at 10:00 a.m. at Joe Lilla’s property located on Green Valley Road where the proposed non-metallic mining operation will be.  The purpose of the special meeting was to address concerns raised at the town board meeting of July 11, 2005 by neighboring property owners. There was discussion regarding drainage of water, a berm required next to the pond on land adjacent to the Lilla property and ways to control dust and noise from the mining operation.

 

MOTION (Powers/Lewis/PASSED unanimously) to recommend approval of Request C-7-03 from Joe Lilla, Jr. for a conditional use permit for the operation of a non-metallic mining operation on his property of 61.00 acres between Green Valley Road and State Highway 32 to the Shawano County Planning, Development and Zoning Committee with the following conditions:

  1. All permits needed from the DNR, State of Wisconsin, and Shawano County are granted.
  2. All trucks leaving the pit must take Green Valley Road to Middle Drive (not through Krakow).
  3. The property line setback must be at least 100 feet.
  4. Use of a silt fence, no spoils on wetlands.
  5. No operation during road weight limit period.
  6. No water pumped into the woods on the southwestern edge of the property.
  7. An approved reclamation plan is used and started as soon as possible after material is taken.
  8. Hours of operation will be from 6:00 a.m. to 6:00 p.m. Monday-Friday and 6:00 a.m. to 12:00 p.m. Saturday.
  9. No water will be pumped off of the premises.
  10. No topsoil will be removed from the property.
  11. A six-foot cement block fence will be erected on the north property line from the west property line to an easterly point that is as far back as the back property line of the Ken Wall property.  Changes to this may be made at the discretion of the Town of Angelica Town Board of Supervisors.
  12. The distance of the edge of the mine from an existing residence is to be 500 feet.

 

MOTION (Lewis/Powers/PASSED) to adjourn the meeting.  The meeting was adjourned at 11:20 a.m.
