Call to Order/Roll
Call/Verification of Meeting Notice: Chairman Smith called the meeting to order at
6:30 p.m. followed by the Pledge of Allegiance. All officers were present for Roll Call. Smith verified with Clerk Powers that
proper posting of the meeting had been done.
MOTION (Lewis/Powers/PASSED) to approve the agenda as presented.
Approval of Prior Town Board Minutes: MOTION (Powers/Lewis/PASSED)
to accept the minutes of the regular town board meeting of April 11, 2005
as presented by the Clerk.
Approval of Treasurer’s Monthly Report: The
Treasurer’s report was presented to the board by Treasurer Matuszak showing
balances as of April 30, 2005 of
$111,648.14 at the F & M Bank in Pulaski, $169,284.29 at the Premier
Bank in Pulaski and CD#45270840018 in the amount of $60,882.69. MOTION (Powers/Lewis/PASSED) to approve
the Treasurer’s report as presented.
Correspondence: Correspondence
reviewed was (1) invoice from Pulaski Tri-County Fire Department for a fire on
County Road C (2) letter from Rural Insurance regarding potential changes in
coverage related to terrorism (3) letter from Shawano County Treasurer in
regard to real estate tax sale of three lots in Krakow (4) letter from Pulaski
Community Schools regarding new school board officers (5) announcement from
D.N.R. regarding a recycling grant award of $8,405.83 to the town (6) copy of
conditionally approved cooler work for Northwestern Pub in Zachow by Wis. Dept.
of Commerce (7) copies of seven Shawano County land-use permits issued for
property in the town (8) notices of meetings of Shawano County PD&Z, Wind
Turbine Citizen Advisory and Board of Adjustment committees, and (9)
newsletters from Pulaski Area Historical Society and Forest Tax Stewardship
News.
Reports from Town
Officers: Chairman Smith reported that (1) the town plans to
do crack filling on Hillside Drive, Middle Drive, Deer Drive, Willow Road, Elm Road
and Cuba Drive for approximately $11,125.00 which is about $1,125.00 over the
budgeted amount and do seal coating on Middle Drive and Green Valley Road for
approximately $20,000.00 which is $3,000.00 over the budgeted amount (2) he will be contacting Randy Zastrow
regarding finishing the blacktopping of Hillside Drive and blacktopping on
Willow Road (3) he has been trying to get together with the DNR to look at the
reconstruction project on Willow Road and try to get permission to relocate the
navigable stream in order to provide a
shoulder for the reconstructed road.
Supervisor Lewis reported that he had issued culvert/driveway permits;
had a call regarding drainage problems with water back up on private property
in Krakow; a request to widen a field driveway on Nichols Drive; and he would
be charging one-third or one-fourth of the value of a new culvert according to
a list he had recently received for used culverts being sold dependent upon
condition of the used culvert.
Supervisor Powers reported on 911 signs and a meeting he had attended as
a member of the Shawano County Highway Committee. Treasurer Matuszak reported on issuing of dog licenses and the
delinquent dog license report she sends to Shawano County. Clerk Powers reported on the issuance of six
building permits since the last meeting, three of which were for homes; an
application submitted for a Recycling Efficiency Incentive Grant was approved
and the town will receive $1,141.86 in June;
no response to a March 16th
letter to Attorney Kenneth Rottier requesting he review proposed changes
in the town’s building permit ordinance.
Report from Planning
Committee Chairman: Chairman Richard Ferfecki reported that he had put
the Planning Committee aware of their upcoming involvement in working on the
Comprehensive Plan (Smart Growth) for the town.
Public Comments: Joe and Tina Socha asked what could be done about a drainage problem in front of their property and said a twenty-four inch culvert was crushed when equipment doing road reconstruction was parked on their property and also that there is a drainage problem because of the backup of water near some low land they own and they believed this could be corrected with the present twelve-inch culvert being replaced with a larger culvert. Chairman Smith said he would check into the matter. Steve Effert brought up a safety concern with the many cars turning off of STH-32 into business places and asked if there could be a lower speed limit from just south of Krakow to the Fairview School. This is something that would have to be worked out with the D.O.T. Elmer Kraning had a concern about the financial status of the N.E.W. Rescue Squad. Peter Kruit was present and asked if the board had any concerns in regard to how his agency was issuing Wis. U.D.C. permits for new one and two-family dwellings.
Specific Matters for
Discussion and Possible Action by Town Board in Open Session:
Old Business:
a. Luther Hoffmann was not present at this meeting and
therefore no action was taken on his request to do ditching in town road right
of way.
New Business:
b. Rueben Specht explained that his driveway washes out
every year and he is looking for a way to correct the problem either by placing
new ends on the culvert, cementing in the ends of the culvert, or putting
blaster rock around the ends. Chairman
Smith said he has been trying to get in touch with the county in regard to
suggestions on how to take care of this problem and that he would be getting
back to Specht.
c. Jim Mills was present in regard to a request to add
10 feet on to an existing 24-inch x 78-foot driveway culvert that serves his
residence and also is used as a field entrance on the east side of this
culvert. Mills stated that because of
trees alongside the driveway and also an electrical box, large field equipment
cannot make the turn into the field on the east side of the driveway. Mills felt that if an opening had to be left
between two culverts there would be the danger of a piece of equipment dropping
into that space and overturning. Supervisor Lewis had been out and viewed the situation. MOTION (Lewis/Powers/PASSED) to allow
Jim Mills to add ten feet on to the east end of the existing 78-foot culvert
that would serve as a field entrance.
d. Request Z-1-05 by Nancy Gueller for a zone change
from C-G, General Commercial, to R-M, Multi-Family for the purpose of operating
a five-unit multi-family dwelling at N4850 Main Street in Krakow. Gueller explained that this property is
presently zoned General Commercial for both a gun shop and living quarters and
in the process of financing she was told to have the zoning corrected to a
multi-family zone for five units and her own living quarters. This request was recommended for approval by
the Town of Angelica Planning Committee on May 3, 2005 with a condition that a
“No Parking” sign be placed sixty feet back from the stop sign located near the
corner of the building. MOTION
(Lewis/Powers/PASSED) to recommend to the Shawano County Planning,
Development and Zoning Committee that this request be approved for a zone
change from C-G, General Commercial to R-M, Multi-Family, for property located
at N4850 Main Street in Krakow.
e. Request C-2-05 by Doug Van Lannen for a conditional
use permit to construct three wetland scrapes totaling 3.2 acres on his property
located at N4521 Green Valley Road.
Doug Van Lannen stated that he
would have over a 100-foot setback from the center of Green Valley Road and
that all plans had been approved by Joseph Waukechon of the USDA Soil
Conservation Service. Van Lannen has
obtained a Shawano County Planning and Development Land Use Permit for this
project. This request was recommended
for approval by the Town of Angelica Planning Committee on May 3, 2005 with the
condition the scrapes must follow all plans drawn by the Soil Conservation
Service. MOTION
(Lewis/Powers/PASSED) to approve Request C-2-05 to construct three wetland
scrapes according to plans drawn up by the USDA Soil Conservation Service on
property located at N4521 Green Valley Road.
f.
Steve Effert and Tom Gwidt
of the Krakow Advancement Association were present and submitted a list of
projects they would like to see done at the Town of Angelica Krakow Community
Park. The projects included (1)
replacing bleacher boards (2) adding 10 yards of hardwood bark to areas of the
park (3) re-build the ball diamond by adding a sand/clay mixture to the infield
and removing soccer net frames from that area, doing some skid-stir work and
rebuilding the back stop (4) adding sand and straightening volley ball poles
for the volley ball courts and (5) moving grills closer to the pavilion
building and install volleyball and tennis court nets. The estimated cost for materials only was
$1,575 and all the labor would be donated by the Krakow Advancement Association
members. Effert explained that the
condition of the bleachers is a safety issue and because of the condition of
the ball diamond, it was not being used.
Effert also requested that there be a yearly budget item/amount that the
Association would have to keep maintaining the park. MOTION (Lewis/Powers/PASSED) to allow the Krakow
Advancement Association to spend up to $1,575.00 to do maintenance work at the
park as requested in their Project List. It was also suggested that the sale of
the soccer net frames be negotiated and proceeds from the sale be used for
projected projects. Supervisor Powers
suggested that the Association keep track of the labor hours involved in doing
the work.
g. A Policy on Open Burning in the Town of Angelica was
reviewed that could be used as a handout to people inquiring about burning in
the town and also have as information on the website. MOTION (Powers/Lewis/PASSED) to approve the policy on Open
Burning as was reviewed by the board.
h. There was a discussion regarding an April 27, 2005
letter from the Shawano County Sheriff’s Department, which letter requested the
town take the following steps to further aid in the successful prosecution of
those who have not paid for dog licenses: (A) verification by telephone or in
person that there is a dog over 5 months of age at the residence of those
people on the Delinquent Dog Owners list that is filed with the Shawano County
Clerks Office (B) the verification is
done near the time that the report is filed with the County Clerk and (C) the
dog owner has all the dog’s shots up-to-date.
Ray Piechota was present and said that he would be interested in taking
over the duties of the Animal Control Person for the town. Wilbert Lewis had been the Animal Control
Person in the past and is now a newly elected supervisor of the town. MOTION (Powers/Lewis/PASSED) to
appoint Ray Piechota as the Animal Control Person for the Town of Angelica.
i.
There was discussion
in regard to changing requirements for width of driveways as stated in Driveway
& Culverts Ordinance 10-13-97. The
present requirement is that a driveway be a minimum width of 20 feet. A property owner has plans to construct a
900-foot driveway and questioned if it was necessary to go to the expense of
providing a 20-foot driveway for this long distance. Chairman Smith had checked with Fire Chief Frank Wichlacz and was
informed that the Fire Department could get by with 10 feet; would like to have
a driveway be 12-feet in width and said it would be optimum to have a 15-foot
driveway for fire equipment to have access in case of a fire. MOTION (Lewis/Powers/PASSED) that
Section 1.08 (d) of the Driveway & Culverts Ordinance 10-13-97 be changed
to read: Driveways for new residences
must have a gravel, blacktop or cement surface and must be a minimum width of
25 feet at the intersection with the road r.o.w. to a point 25 feet back from
the road r.o.w. Beyond that point the
driveway may be tapered down to a width of not less than 15 feet. Any driveway over 500 feet must provide for
a turn-around at the ending of that driveway.
The revised ordinance will be brought to the June meeting for approval.
j.
At the town annual
meeting the Pulaski Tri-County Fire Department said that the dry hydrant on
Green Valley Road was tipping and they would do the work in straightening it
but requested the town provide gravel for the area. MOTION (Powers/Lewis/PASSED) that the town pay for gravel
needed for the dry hydrant on Green Valley Road.
k. The planned buyer of a property in the town has
asked about the status of Hill Drive and if it would be graveled. The property does not have road frontage and
is accessed by the dead-end Hill Drive which has a length of approximately .23
of a mile. This road is on the D.O.T.’s
list of town roads and we receive transportation aids on it. Smith pointed out that the present road is
very narrow and would have to be brushed out before any gravel be placed on
it. MOTION (Powers/Lewis/PASSED) to
wait on doing any improvements to Hill Drive until a purchase of the land being served by it takes place.
l.
A concern about safety
of children playing on the ball diamond in Zachow was discussed. MOTION (Powers/Lewis/PASSED) to place
“Children at Play” signs at each end of the ball diamond area next to the road
in Zachow.
m. Edwin and Marilee Kazik were present in regard to
the status of the Hillside Cemetery Association. Marilee’s mother, Beatrice Tank, was the last remaining member of
the Association and she passed away recently.
The Kaziks had been taking care of maintenance of the cemetery before
her death and Beatrice Tank, Treasurer of the Hillside Cemetery Association,
signed a statement on May 6, 2002 stating she wished to turn over the Angelica
Hillside Cemetery Association account to her daughter, Marilee Kazik for all
accounts payable. The Kaziks informed the board that a retaining wall that cost
approximately $12,000.00 had recently been constructed and informed the board
that about two-feet of fill is needed in some areas next to that retaining wall
and asked if the board could provide the fill needed. Edwin Kazik said that in order to make parking safer at the
cemetery the Association was willing to pay for a curb at the property line in
front of the cemetery and also the blacktopping of an area between the curb and
roadway that could be used for parking.
MOTION (Powers/Lewis/PASSED) that inasmuch as the last remaining
member of the Hillside Cemetery Association has passed away, the town board now
wishes to appoint Edwin Kazik and Marilee Kazik as members of that Association
and they are to continue the same duties as the Hillside Cemetery Association
has been performing in the past. It
was suggested that the Kaziks give the town board some kind of a financial
report once a year and Edwin and Marilee Kazik said they would do that.
Specific Town Board
Notice and Agenda for Upcoming Town Board Meeting: The next town board
meeting will be held on the first Monday of the month rather than the second
Monday and will be on Monday, June 6, 2005.
Voucher Listing/Payment
of Bills: MOTION (Lewis/Powers/PASSED) to approve vouchers No. 2736 through No.2759.
Adjournment: MOTION (Powers/Lewis/PASSED) to adjourn the meeting. The meeting was adjourned at 9:35 p.m.
