Call to Order/Roll Call/Verification
of Meeting Notice: Chairman Smith called the meeting to order at
6:30 p.m. followed by the Pledge of Allegiance. All officers were present for Roll Call. Smith verified with Clerk Powers that proper
posting of the meeting had been done.
Approval of Prior Town Board Minutes: MOTION (Powers/Lewis/PASSED) to accept the minutes
of the regular town board meeting of August 8, 2005, and hearing of August 8,
2005 in regard to addition of territory to Krakow Sanitary District No. 1 as
presented by the Clerk.
Approval of Treasurer’s Monthly Report: The
Treasurer’s report was presented to the board by Treasurer Matuszak showing
balances as of August 31, 2005 of
$106,130.86 at the Citizens Bank in Pulaski, $170,957.14 at the Premier
Bank in Pulaski. MOTION
(Lewis/Powers/PASSED) to approve the Treasurer’s report as presented.
Correspondence: Correspondence
reviewed was (1) CSM’s for 2 lots on Willow Road and 1 lot on County Road
C (2) copy of letter from DNR to
property owner in Section 8 in regard to proposed project (3) notice of intent
to reissue a Pollutant Discharge Elimination System permit for Graf Creamery
from DNR (4) copies of Shawano County Ordinance No. 7-05 and No. 5-05 (5)
notification from Assured Inspection Services that they issued no building
permits for home in July and one building permit in August (6) notification from state Demographic
Services that the town’s 2005 preliminary estimate of population is 1,747
people (7) 2005 Equalization Report from D.O.R. stating equalized values for
municipalities in Shawano County (8) notice from D.O.R. that shared revenue
balance of $78,020 will be paid on November 20th (9) copy of “First
Amended Complaint” filed in Brown County Circuit Court with the four towns,
Village of Pulaski and N.E.W. listed as Plaintiffs versus Tri-County Rescue
Squad, Inc. (10) copies of 8 land-use permits issued by Shawano County for
property in the Town of Angelica (11) notices of meetings of Shawano County
PD&Z, Board of Adjustment and Land Conservation committees (12) brochure
from OMNI in regard to Comprehensive Planning.
Reports from Town
Officers: Supervisor Lewis reported (1) he had been in Zachow
in regard to a burning problem and has left copies of the town’s burning policy
with the residents and also at Graf Creamery (2) he had gone over to Green
Valley Road to check out a complaint in regard to a culvert. Supervisor Powers reported (1) the county
has hired a replacement for the Highway Superintendent position that had been
vacant because of Randy Zastrow being
appointed the Highway Commissioner (2) Green Valley Supervisor Gary Ullmer had
contacted him in regard to what the town had planned on future road work for
Carroll Road, and (3) importance of attending a Pulaski Community School
District annual meeting as a resolution for change in the election of school
members will be brought up.
Chairman Smith reported
(1) at the N.E.W. Para-Medic Rescue board meeting he was informed that in July
there were 59 runs and for the first five months a total of 203 runs ~ 13 first
responders are now taking classes, of which 7 are from Carver Boat, 3 people
are taking EMT classes and 1 person ia taking a Para-Medic class ~ starting
with next month’s meeting he will be getting a copy of a financial report from
N.E.W. and will bring it to our town board meeting (2) At the August 25th
meeting of the Pulaski Tri-County Fire Department board they were given
financial reporting and also results of an audit done by Shenk showing
everything was in order with some recommendations in up grading of the book
keeping system ~ the new tanker truck is in operation ~ a $20,000.00 DNR grant
has been applied for (3) received a request from a property owner on West Town
Road in regard to a drainage problem and it was suggested there be a meeting of
the property owners involved, which meeting was tentatively set for Tuesday,
September 27, 2005 at 6:00 p.m. at the town hall. Clerk Powers reported on town building permits issued in the past
month, publication of an ad in regard to refuse being thrown in town ditches
and asked the board how to proceed on an issue regarding a property owner
failing to obtain a building permit after being notified of the requirement to
obtain a permit.
Report from Planning
Committee Chairman: Town of Angelica Planning Committee Chairman Richard
Ferfecki reported (1) he had approved a CSM for lots on Willow Road and a CSM
for a lot on County Road C and (2) he had notified a property owner on Green
Valley Road to stop a digging and filling project that was being done without
town, county or DNR permits.
Public Comments: Elmer Kraning had an unfavorable report of a recent incident where he was present when N.E.W. Para-Medic Rescue was called for service in Angelica. Chairman Smith asked Kraning to provide him with the date of the incident. Ronald Banaszynski asked how the road r-o-w in front of his property would be left after reconstruction work is done. Chairman Smith said that reclaiming work is scheduled to be done soon on Town Hall Drive and Willow Road and the town hoped to be able to put a binder coat of blacktop on the two roads this fall with final blacktop and shouldering work to be done next year.
Specific Matters for
Discussion and Possible Action by Town Board in Open Session:
a. A petition to vacate a portion of Tony Street in
Krakow had been presented to the town on July 20, 2005 and Notice of Pendency
was recorded on September 12, 2005 with the Register of Deeds in Shawano
County. There was discussion in regard
to drainage of water over the portion being petitioned to vacate. The town had contacted an attorney and was
advised to obtain deed restrictions on the portion to be vacated in order to
ensure that that area could not be altered or filled in to prevent drainage in
the future. Debbie Holewinski, one of
the adjacent property owners, said she could have deed restrictions made up at
no charge through the law office she works at.
MOTION (Smith/Lewis/PASSED) to table this agenda item until the
October town board meeting at which time signed deed restrictions would be
received and a decision could then be made in regard to the petition.
b. Brian Thome, District Manager of Waste Management,
presented the town board with a proposal for bi-weekly pickup of trash and
recyclables and a quoted monthly rate per unit. As this is a service contract and advertisement for bidding is
not required it was the general consensus to request proposal/quotes from
several other firms that provide this kind of service in the area and discuss
it at the October town board meeting.
Sue
Shultz, a town resident who resides at W1580 Hillside Drive, was present in
regard to a recent incident where a Waste Management truck did damage to her
electric service while picking up garbage.
It was the general consensus that this would have to be worked out
between Shultz and Waste Management.
Thome indicated that their insurance company is working on the matter.
c. Joel Paschke and Chad Legreve were present in regard
to their bringing fill from the back of Paschke’s property to the front in the
area of a new house being built and hauling in fill without having obtained
permits from Shawano County and the Town of Angelica. The removal of fill
caused an area of approximately 100 feet by 100 feet to fill with water and
this could be considered a pond which would require a conditional use permit at
the town level and land-use permit at the county level. Also there is a question as to whether or
not the area where fill has been removed is within distances that would require
a conditional use permit under the Shawano County Shoreland Ordinance or a
permit from the D.N.R. MOTION
(Powers/Lewis/PASSED) to table any action on this to the October town board
meeting. Paschke was advised to contact
someone in the Shawano County Planning & Development Department to
determine what permits are needed and what his options are in regard to his
situation.
d. Applications for two operator’s licenses from Janice
Robaidek and Nancy Jaworski were reviewed.
MOTION (Powers/Lewis/PASSED) to grant Operator’s Licenses to the
two people applying.
e. The present fees for driveway/culvert permits are
$25.00 for a driveway to a home or building and $10.00 for a field
entrance. It was felt that a different
fee should be charged for a driveway/culvert permit for commercial
property. MOTION
(Lewis/Powers/PASSED) to keep the fees for driveway/culvert permits at
$25.00 for a driveway to a home or building and $10.00 for a field entrance and
to charge a $50.00 fee for a driveway/culvert permit for a commercial driveway.
Specific Town Board
Notice and Agenda for Upcoming Town Board Meeting: The next town board
meeting will be held on the Monday, October 10, 2005. The two agenda items that were tabled at this meeting will be on
the October agenda. Chairman Smith also
asked the two supervisors to bring their recommendations on what two miles of
road should be reconstructed next year and the reasons why.
Voucher Listing/Payment
of Bills: MOTION (Lewis/Powers/PASSED) to approve vouchers No. 2864 through No.2896 as
presented with a change from statement received on V-2892 as printed.
Adjournment: MOTION (Lewis/Powers/PASSED) to adjourn the meeting. The meeting was adjourned at 8:45 p.m.
