Special Meeting ~ May 26, 2006

Town Officials Present: Chairman, Richard Smith, Supervisor Cliff Powers, Supervisor Wilbert Lewis, and Clerk Janet Powers

Town Officials Absent: Treasurer Lisa Matuszak

Others Present: none

The special meeting in regard to drainage problems on Elm Road and in Krakow, which was held at the Clerk’s office, opened at 11:00 a.m. Chairman Smith informed the board that he has checked with WTA Attorney Tara Fermanich and she informed him when drainage problems are on private property, State Statute 88.90 would apply.

1. It was the general consensus to have a meeting between property owners, Roger Perret, John Downey and Bradley Prentice to inform them of the requirements of State Statute 88.90 ~ Removal of obstructions from natural water-courses. The town board would also give Roger Perret an option of having the town ditch in front of his property being dug deeper to allow the water to drain from the three properties affected but the cost of digging the ditch deeper would have to be borne by Roger Perret. Per State Statute 88.90 the two property owners affected by the blocking of water on Perret’s land, John Downey and Bradley Prentice, would have to give notice in writing to Roger Perret to remove the obstruction to the drainage. A tentative date for this meeting was set as Monday evening, June 5.

2. It was the general consensus to have a meeting between the property owners in Krakow from the area of Center Street, Wencel Street and Julius Street to inform them of the requirements of State Statute 88.90 and also inform the property owners on Center Street and Wencel Street that are affected by water not draining that they would have to give a notice in writing to the property owners that have a drainage course on their property which needs to be cleaned out to allow proper drainage of water. The proposed meeting will be an agenda item for the June 19, 2006 town board meeting.

The meeting was closed at 1:00 p.m.
