Monthly Meeting

September 11, 2006

 

 

Town Officials Present:   Chairman, Richard Smith,  Supervisors, Clifford Powers and Wilbert Lewis, Treasurer Lisa Mauszak and Clerk, Janet Powers

Town Officials Absent:          None

Others Present:                         Richard Ferfecki, Town of Angelica Planning Committee Chairman, Sylvester Socha, Eugene Beyersdorf, James W. Mills, William J. Crouse, Ron Banaszynski, Jeffrey O’Harrow and Elmer Kraning

 

Call to Order/Roll Call/Verification of Meeting Notice:  Chairman Smith called the meeting to order at 6:30 p.m.  There was a moment of silence in commemoration of the five-year anniversary of the September 11th attack on the World Trade buildings in New York which was followed by the Pledge of Allegiance.  All officers were present for Roll Call.   Smith verified with Clerk Powers that proper posting of the meeting had been done.  The agenda was posted on the morning of September 8, 2006 and also faxed to the Shawano Leader.

 

Approval or  Modification of Agenda:   MOTION (Powers/Lewis/PASSED) to approve the agenda as posted.

 

Approval of Prior Town Board Minutes:  MOTION (Lewis/Powers/PASSED) to approve the minutes of the regular town board meeting of August 7, 2006. 

 

Approval of Treasurer’s Monthly Report:  The Treasurer’s report was presented to the board by Treasurer Matuszak showing balances as of August 31, 2006 of  $92,900.97 at the Citizens Bank in Pulaski and $90,849.08 at the Premier Bank in Pulaski.  MOTION (Lewis/Powers/PASSED) to approve the Treasurer’s report as presented.

 

Correspondence:  Correspondence reviewed was (1) preliminary estimate of population of 1,752 as of January 1, 2006 from State Demographic Services Center (2) notification of Equalized Valuations from Wisconsin D.O.R. (3) 12 land-use permits issued by Shawano County for property in the Town of Angelica (4) notices of meetings of Shawano County PD&Z, Land Conservation committees and Board of Adjustment (5) information regarding upcoming WisLine sessions on current issues affecting local government officials (6) Wisconsin D.O.A. Local Government Report for August (7) brochures from OMNNI Associates and American Planning Association and (8) survey card from Scott Construction.

 

Reports from Town Officers:  Supervisor Lewis reported on culvert permits he had issued since the August meeting and requests he had received from property owners Dickson, Kroening, Davis and Nowak to clean out their ditches because of drainage problems.  Lewis also reported that there were five used culvert pipes for sale.  Supervisor Powers reported on 911 numbers he had installed and that Shawano County has hired a civil engineer who could be used by the towns.  Powers also reported that a property owner on Beech Drive had approached him in regard to a concern about his survey stake being removed in reconstruction of that road and a concern the Staffords in Krakow had about replacement of a culvert which was taken out and is causing water backup problems on their property.

 

 

Chairman Smith reported (1) at the monthly meeting of the Tri-County Fire Department Board of Directors the proposed 2007 budget was reviewed, which budget showed a 5.3% increase.  Also, the Fire Department board is proposing amending the bylaws with the addition of Sections entitled “Preclusion of Membership, Continued Membership or Promotion for Any Member or Prospective Member Convicted of Any Felony”.   Smith passed this proposed amendment by those present at the meeting and asked for a voice vote on whether or not this should be put in the bylaws.  The result was 12 for the proposed amendment and 1 opposed.  (2) at the monthly meeting of the N.E.W. Para-Medic Rescue Board of Directors it was reported that the Rescue Squad is operating in the black and there were 32 runs in the past month (3) the reconstruction of Beech Drive is proceeding well and he had met with Grant Bystol regarding paver patching and blacktopping of town roads (4) he and Richard Ferfecki had met with the Shawano County Planning & Zoning Director to clarify the status of back 40’s that were lots of record and the ability to build a home on these lots with the provision of a 66’ easement.  This clarification will now be reviewed by County Corporate Counsel. 

 

Clerk Powers reported on the tests that were done on the new automatic voting machine that can be used by the handicapped and other voters.

 

Report  from Town Planning Committee Chairman:  Chairman Richard Ferfecki was present and said he would bring up his comments at the time items came up on the agenda. 

 

Public Comments:  MOTION (Lewis/Powers/PASSED) to open the meeting for public comments.    Bill Crouse and Wilbert Lewis asked about getting their driveways blacktopped this year.  Lewis brought up a concern that Ron Krajewski had of trespassing on property where a new house was being built on Green Valley Road and dogs running loose in front of his property and agitating his dog.  Smith informed Elmer Kraning that three Town of Angelica road signs were found in the town of Lessor and asked Kraning to check if signs were in place for these roads.  MOTION (Lewis/Powers/PASSED) to close the public comment portion of the meeting.

 

Specific Matters for Discussion and Possible Action by Town Board in Open Session: 

 

New Business:

 

a.       (1) Sylvester Socha was present in regard to his Request CU-3-06 for a town conditional use permit for two wildlife scrapes on his property located on Green Valley Road near Cuba Drive.  These wildlife scrapes were being done under the supervision of the Natural Resources Conservation Service and he showed the board a scale map and cross section detail of the scrapes.  These scrapes will have a 8-1 slope.  Socha explained that the NRCS had a change of personnel and they were not aware of the requirement of a town conditional use permit.  Richard Ferfecki, Chairman of the Town of Angelica Planning Committee informed the board that the Shawano County Planning & Zoning Office informed him that now a county land-use permit is not required for the wildlife scrapes.  In the past the County had required this of previous requests for wildlife scrapes.  MOTION (Powers/Lewis/PASSED UNANIMOUSLY) to grant conditional use permit CU-3-06 for two wildlife scrapes as presented by Sylvester Socha.

 

(2) Ferfecki also informed the board that another meeting of the Planning Committee in regard to the comprehensive plan will be held the first week in October at which time the Committee will be reviewing maps and preparing a mission statement.  Ferfecki also reported that present flood plain mapping in the town doesn’t correspond to the FEMA mapping and because of budget cuts it isn’t known when this issue will be resolved.

b.      Gene Beyersdorf was present  in regard to his requesting the town to vacate a portion of Carroll Road lying between two parcels of land he owns for a distance of .04 mile south of its intersection with Beech Drive in order that he could comply with required setbacks when building a new garage on his property.  He was given a list of steps he would have to take for the board to prepare a resolution to discontinue that portion of Carroll Road and it was recommended he contact an attorney to prepare an easement on that portion of Carroll Road that would be vacated and turned over to him and also to prepare a legal description of that area.

 

c.       The town board and Planning Committee Chairman Richard Ferfecki reviewed a draft of a proposed ordinance to establish a Town of Angelica Plan Commission.  A copy of the proposed ordinance with recommended changes will be forwarded to Ferfecki for review by the present Town of Angelica Planning Committee.

 

d.      Applications for Operator’s Licenses submitted by Rick Wagner, Monica K. Wagner, Steve R. Wegner, Seth W. Boettcher, Andrew Buss, Amanda B. Schmoll and Joshua Merrigan were reviewed.  MOTION (Smith/Powers/PASSED) to issue licenses to all the applicants.

 

 

Specific Town Board Notice and Agenda for Upcoming Town Board Meeting:  The next town board meeting will be held on October 9, 2006, the second Monday of the month.    Items that possibly will be on the agenda are approval of a Planning Commission Ordinance and discussion on the revaluation of property assessments with R & R Assessing.

 

Voucher Listing/Payment of Bills:     MOTION (Lewis/Smith/PASSED) to approve payment of vouchers V-3287 through V-3331.

 

Adjournment:  MOTION (Lewis(Powers/PASSED) to adjourn the meeting. The meeting was adjourned at 9:00 p.m.
