Call to Order/Roll
Call/Verification of Meeting Notice: Chairman Smith called the meeting to order at
6:30 p.m. Roll call showed all
officials were present. It was verified
with Clerk Powers that proper posting of the meeting had been done. The agenda was posted on the afternoon of
April 5, 2007 and also faxed to the Shawano Leader on March 5th.
Approval or Modification of Agenda: MOTION
(Powers/Lewis/PASSED) to approve the agenda as posted.
Approval of Prior Town Board Minutes: MOTION (Lewis/Powers/PASSED) to approve the
minutes of the regular town board meeting of March 12, 2007.
Approval of Treasurer’s Monthly Report: The
Treasurer’s report was presented to the board by Treasurer Matuszak showing
balances as of March 31, 2007 of
$67,212.20 at the Citizens Bank in Pulaski and $226,476.49 at the
Premier Bank in Pulaski. MOTION
(Lewis/Powers/PASSED) to approve the Treasurer’s report as presented.
Correspondence: Correspondence
reviewed was (1) letter from County Sheriff’s Department regarding the
verification of names on the list of “Delinquent Dog Owners” that is sent to
the County Clerk (2) letter from D.O.R. regarding the Assessor’s Final Report that is due in May (3) two incident
reports from the Tri-County Fire Department (4) three land-use permits issued
for property in the town by Shawano County in the past month (5) notices of
meetings of Shawano County Committees (6) brochures from Mid-American Planning
and Vierbicher regarding grant opportunities and (7) Energy 2012 Final Report
by the Public Service Commission of Wisconsin.
Reports from Town
Officers: Supervisor Lewis reported he had been contacted about a driveway
permit on Town Line Road for access to a storage building and a concern about the driveway possibly
blocking water drainage. Supervisor
Powers reported he had put up a 911 number for Performance Excavating’s sand
pit on Elm Road, calls he had received about sweeping the streets in Krakow and
pot holes on Green Valley Road, cleaning up the road r.o.w. in Zachow before
the people mow the grass, allowing the Krakow Sanitary District to post
meetings on the town’s posting board and an upcoming Emergency
Management/Shawano Area Disaster Response & Recovery workshop sponsored by
Shawano County on April 26th.
Chairman Smith reported
(1) the N.E.W. Paramedic Rescue Squad had received a $50.00 donation from two
couples in the Town of Pittsfield, had sold the old washer and dryer for $400.00
and put that money in the equipment fund and had purchased radios for the 1st
responders from the donation made by Allen Canning. The Annual Meeting of the Rescue Squad will be held on April 23,
2007 at 1:30 p.m. (2) there will be an area Emergency Management/Disaster
Meeting at 6:00 p.m. on April 23rd (3) balances in the Checking Account,
Vehicle Fund and Camera Imaging Accounts reported at the last Tri-County Fire
Department meeting and costs involved in the major fire at Arrow Concrete. It was suggested that the town’s ordinance
regarding charging for fire calls be reviewed at the May town board meeting (4)
he had gone over the town roads with a representative from a crack filling
service and obtained estimates for crack filling and seal coating the roads
this year and (5) he and the Tri-County Fire Department fire chief were going
to attend a WisLine Program at the Shawano County Court House conducted by
representatives from the Internal Revenue Service and Wisconsin Department of
Revenue regarding handling payments to volunteer firefighters.
Clerk Powers reported
on: (1) upcoming Town Officials Workshops in April and May sponsored by Ruder
Ware business attorneys and the Wisconsin Towns Association (2) the Public
Officials Bond that is to be renewed on June 15, 20097 for the Clerk and
Treasurer (3) suggested dates for Open Book on Thursday, May 3rd
from 5:00 p.m. to 7:00 p.m. and Board of Review on Tuesday, May 22nd
from 6:00 p.m. to 8:00 p.m. and (4) building permits issued in the past month.
Report from Town Planning Committee Chairman: Town
of Angelica Planning Committee Chairman Richard Ferfecki was present and
reported: (1) The Planning Committee
had a meeting on March 19, 2007 where the committee and town residents were
split into groups and worked on land zoning mapping for the town. Ferfecki informed the board of a recommended
cluster zone where 80-acre or 160-acre parcels
could have restrictive zoning where just a portion of the parcel could
have residential zoning and the remainder would be kept in agriculture. (2) he
attended a Pulaski Village comprehensive planning meeting on March 28th (3) new FEMA mapping will be available soon
and (3) he had approved CSM’s for the Wilinski property consisting of six and
one-half acres with buildings and
another six acre parcel.
Public Comments: MOTION (Lewis/Powers/PASSED) to open the meeting up to public comments. Connie Rohloff had a concern about the number of accidents happening in front of her home on Green Valley Road. A “low shoulder” and “slow” signs had been erected there and seemed to help for a while but there have been two recent accidents, one of which required response by the rescue squad, right in the area of their driveway. Rohloff asked if something could be done to help prevent future accidents. Chairman Smith responded that the town would look into the matter and see if something could be done about widening the road shoulder in that area. MOTION (Powers/Lewis/PASSED) to close the public comment portion of the meeting.
Specific
Matters for Discussion and Possible Action by Town Board in Open Session:
New Business:
a.
(and) b. The Town of Angelica Planning Committee forwarded combined
requests: Request CU-3-07 and Z-1-07 by Performance Excavating for a conditional
use permit for operating a non-metallic mining site for the extraction of sand
material on a vacant lot off of Old Dump Road by Hickory Drive and a zone
change from Manufacturing to Open Forest on a 7-acre parcel 004-09130-0010 and
40-acre parcel 004-09110-0000 they have purchased from Shawano County and which
the County requested be rezoned if this land was going to be used as a
quarry. Tom Maroszek of Performance
Excavating was present and answered questions regarding monitoring wells on the
property. The three townships of
Hartland, Maple Grove and Navarino have the responsibility for landfill cap
maintenance and paying a portion of the annual monitoring well fees that are
overseen by the DNR for wells located on this property which is overseen by the
DNR. A letter from the Shawano County
Corporation Counsel to the Towns of Navarino, Maple Grove and Hartland in 2005
referred to this property as “Angelica
dump property” but the Town of Angelica was never part of the group of towns
that used it as a dump. Maroszek stated
he is working with Scott Konkel of East Central Planning on the required Land
Reclamation Plan for the sand pit.
MOTION (Smith/Lewis/PASSED UNANIMOUSLY) to recommend approval of
Request Z-1-07 for a zone change from Manufacturing to Open Forest on two
parcels owned by Performance Excavating, namely Parcel 004-09130-0010 of 7
acres and Parcel 004-09110-0000 of 40 acres, to the Shawano County Planning,
Zoning and Development Committee.
MOTION (Smith/Lewis/PASSED UNANIMOUSLY) to recommend approval of
Request CU-2-07 for a conditional use permit to operate a non-metallic mining
site for the extraction of sand material on a vacant lot off of Old Dump Road
by Hickory Drive, Parcel Nos. 004-09130-0010 and 004-09110-000, to the Shawano County Planning, Zoning and
Development Committee with the recommended conditions made by the Town of
Angelica Planning Committee. The
recommended conditions are as follows:
1.
The excavation of sand from the property be as indicated on
drawings/aerial photos and letter dated 3-16-07.
2.
The driveway must be graveled.
3.
Land reclamation plan followed from East Central Planning (Topsoil replaced, etc.). The plan must address the issue of the Old
Dump test wells and its test results.
4.
Hours of pit operation will be from 7:00 a.m. to 6:00 p.m., Mon-Fri,
7:00 a.m. to 12:00 p.m. on Saturday.
5.
100’ property setback (including old dumping area)
6.
The sand excavation/removal conducted in such a manner so as to avoid
any damage or nuisance affect to adjacent property and/or structures.
7.
Locked gates into property
8.
Posting put around property border every 20’ to 30’ indicating “Private
Property – Active Quarry”.
9.
Permit approval will expire in five years – at which time applicant can
reapply for a three-year extension.
10.
The committee may at any time, amend or add conditions to this permit
to ensure compliance with all legal requirements.
b.
MOTION (Smith/Powers/PASSED) to enter into a Joint
Powers Agreement with Shawano County regarding emergency services dispatched through the Shawano County E-911
System as presented to the board by the Shawano County Sheriff’s Department.
c.
James Stocco was present in regard to the status of renovation of his property located at W1545
County Road C. Stocco had filled out a
Preliminary Consultation with the Shawano County Planning & Zoning
Department on June 9, 2006, which was revised on October 10, 2006. To date he has not brought this request for
a variance to the Town of Angelica Planning Committee for review. The board stated to Stocco that they had
been receiving complaints regarding the appearance of the partially torn down
and unfinished building on his property on the corner of County Road S and
County Road C. Stocco explained that:

he was using part of the structure for storage
·
he was working on a deal to sell the property
·
he was not planning on going ahead with the variance request as he had
changed his mind regarding parts of the preliminary consultation
·
he wouldn’t state a date when he would finish the renovation of the
building (probably up to ten years)
No action was taken by the board at this time. They will check the matter out further with
the Shawano County Planning & Zoning Department and get back to Stocco.
d.
Quotes were received from three grass cutting firms for the cutting of
grass and trimming at the town hall and the Krakow Park. MOTION (Powers/Lewis/PASSED) to
accept the low quotes from Schwartz Lawn Cutting to cut the grass and weed trim
at the town hall at $30.00 per cutting and to cut the grass and weed trim at
the Krakow Park at $85.00 per cutting.
e.
The board had discussion regarding roads to be considered for
reconstruction in 2007. Chairman Smith
had gone over the roads that are in bad
condition after the spring breakup with the Shawano County Highway Department
Assistant Commissioner and some suggestions were that the town do paver
patching on Green Valley Road and do re-shouldering on the narrow part of Green
Valley where the accidents were occurring, lay down gravel and mix with the
ground-up blacktop on Carroll Road with plans to reconstruct in 2008, and consider reconstruction on either Town
Line Road from STH-32 west to Green Valley Road or reconstruction work on Maple
Road in 2007. Selecting where reconstruction work will take place will be an
agenda item for the Special Town Board Meeting scheduled for Tuesday, April 17,
2007.
f.
Chairman Smith had gone over crack filling and seal coating of roads
with a representative from a crack filling firm and suggested that the
town start crack filling with Elm Road
going from its intersection with Nichols to Hickory and continue with other
roads where it is needed until the maximum of $10,000.00 that is budgeted is
reached. Smith recommended that the one
and one-half miles of Elm Road from Nichols to Hickory be seal coated in 2007.
g.
There was discussion in regard to having a tire pickup day for
residents to bring old tires in. The
general consensus was that it was too late to plan a pickup day this year but
plans should be made next year at the February meeting and notice of a tire
pickup day could be included in the newsletter that goes out to property owners
in March.

are: The Annual Meeting scheduled for
Tuesday, April 10, 2007 starting at 7:30 p.m., the Special Town Board Meeting
to open bids for the addition to and renovation of the town hall scheduled for
Tuesday, April 17, 2007 starting at 6:00 p.m., Open Book held by the Assessor
on Thursday, May 3, 2007 from 5:00 p.m. to 7:00 p.m. and Board of Review on
Tuesday, May 22, 2007 from 6:00 p.m. to 8:00 p.m.

of Bills: MOTION (Lewis/Powers/PASSED) to approve payment of vouchers V-3622 through
V-3666.
Adjournment: MOTION (Lewis/Powers/PASSED) to adjourn
