Call to Order/Roll
Call/Verification of Meeting Notice: Chairman Smith called the meeting to order at
6:30 p.m. Roll call showed all
officials were present. It was verified
with Clerk Powers that proper posting of the meeting had been done. The agenda was posted on the afternoon of
July 6, 2007 and also faxed to the Shawano Leader on July 6th.
Approval or Modification of
Agenda: MOTION (Powers/Lewis/PASSED) to
approve the agenda as posted.
Approval of Prior Town Board Minutes: MOTION (Lewis/Powers/PASSED) to approve the
minutes of the regular town board meeting of June 11, 2007, and the informational meeting for property
owners on Elm Road and Maple Road held on June 21, 2007.
Approval of Treasurer’s Monthly Report: The
Treasurer’s report was presented to the board by Treasurer Matuszak showing
balances as of June 30, 2007 of
$8,471.19 at the Citizens Bank in Pulaski and $219,091.84 at the Premier
Bank in Pulaski. MOTION
(Lewis/Powers/PASSED) to approve the Treasurer’s report as presented. Treasurer Matuszak also informed the board
that the CD designated for the addition to and remodeling of the town hall will
mature on July 23, 2007.
Correspondence: Correspondence
reviewed was (1) CSM’s for 2 lots on Deer Drive and for 3 lots on Church Drive
(2) notice of approval of a repair garage addition for Performance Auto Body by
the Wisconsin Department of Commerce (3) notice from Northern Lakes Cable TV
regarding sale of the company to Packerland Broadband (4) letter from DNR
regarding assistance with gypsy moth management (5) copies of Shawano County
Ordinances regarding regulation of fireworks, County lands rules and
regulations and amendments to Zoning Ordinance No. 102 (6) notices of meetings
of the Shawano County PD&Z and Land Conservation Committees and the Board
of Adjustment and (7) copies of County land-use permits issued in the past
month.
Reports from Town
Officers: Supervisor Lewis reported he had issued a culvert permit for a
home on Cuba Drive and was working on getting a driveway on Elm Road to conform
to the specified width of the town’s driveway/culvert ordinance .
Supervisor Powers
reported on recent County issues, including approval of a fireworks ordinance
and a proposed ordinance in regard to 911 numbering that is on the Public
Safety Committee’s agenda and could come before the County Board at their July
25th meeting.
Chairman Smith reported
(1) at the last N.E.W. Rescue Squad meeting it was reported they had 34
responses in May with 2 for the Town of Angelica and 185 runs for the year to
date. Smith also reported on balances
in the General Fund, Equipment Fund and Website Fund and that income is lower
than budgeted but expenses are also lower (2) the Tri-County Fire Department
had two meetings in the past month, one in regard to hiring a consultant to go
over procedures of the department from the Board of Directors down to the
members. The fee of $4,480.00 will be
divided between the five municipalities served by the Department. A grant application is being submitted to
the D.N.R. in the amount of $20,000.00 if the Department spends $10,000.00 for equipment. There were 48 runs in the past month with 1
run for a fire on the Mountain Bay Trail in the Town of Angelica and (3) he had
received estimates from the County and Performance Excavating on widening Green
Valley Road to a four-rod width in the area where several accidents have
occurred.
Clerk Powers reported on
town building permits issued in the past month.
Report from Town Planning
Committee Chairman: Chairman Richard Ferfecki was present and indicated
he would save his comments until agenda items regarding the Planning Committee
came up.
Public Comments: MOTION (Lewis/Powers/PASSED) to open the meeting up to public comments. Anthony Steffen asked if Hill Drive couldn’t be widened to at least 15 feet which would be the same width as is required in the town’s driveway/culvert ordinance and also brush out the sumac that is next to the road. Chairman Smith indicated he would have to contact the DNR to obtain permission to widen the road in the area that is in wetlands. Matt Pleshek had a concern about the large amount of gravel stones that were left in the ditch after reconstruction of Beech Drive in front of his property where he cuts the grass. Chairman Smith asked Elmer Kraning to clear out the brush in the road right of way at the corner of Elm Road and Cuba Drive. MOTION (Powers/Lewis/PASSED) to close the public comment portion of the meeting.
Specific
Matters for Discussion and Possible Action by Town Board in Open Session:
New Business:
a.
Mark Gewont, Director of the Shawano County Tavern League, presented
the board with a check of $200.00 as a donation to the Krakow Community Park
and indicated there would be a matching $200.00 donation coming from the State
Tavern League. The board expressed
their appreciation to Gewont for this donation.
b.
Brian Egnarski was present in regard to Request Z-2-07 by Performance
Auto Body for a zone change from AG to CG to allow an existing auto service station
to expand on State Highway 32 north of Pulaski. The request was recommended for approval by the Town of Angelica
Planning Committee at its meeting on July 2, 2007. Planning Committee Chairman Richard Ferfecki stated no one
appeared opposing this request for a zone change and indicated conditions were
recommended in regard to landscaping requirements and architectural control as
specified in the town’s land-use plan.
Egnarski informed the town board that the business was established by
his father in 1965 which was before Shawano County Zoning was established and
an addition to the business was done in 1971 and the septic system was updated
in 2003 with no mention being made to them at those times in regard to how the
business was zoned. Planning Committee
Chairman Richard Ferfecki also brought three concerns to the board regarding
(1) Shawano County requiring a property owner to obtain a variance to put up an
outbuilding further back than 290 feet from the property line in the A-290 zone
(2) a variance request for a property owner in Krakow that is zoned both RS-20
and AG who wants to place a building closer to the property line than allowed
in setback regulations and (3) approval by the County Board of Adjustment for a
request for extension of a variance to construct a single-family dwelling
beyond the 290-foot maximum setback in the A-290 zone.
c.
A draft of Ordinance 7-9-07 in regard to establishment of a Town of
Angelica Plan Commission was reviewed by the board. A copy of the draft had been given to Shawano County Planner
Melinda Barlow for review and was okayed by her. MOTION (Lewis/Powers/PASSED UNANIMOUSLY) to approve
adoption of Ordinance 7-9-07 as presented in the draft of the ordinance given
the board.
A Mission/Vision Statement prepared by the Town of
Angelica Planning Committee was reviewed by the board. MOTION (Powers/Lewis/PASSED) to
approve the Vision Statement as presented to the board by the Chairman of the
Planning Committee Richard Ferfecki.
d.
Applications for twelve Operator’s Licenses were reviewed by the town
board. MOTION (Smith/Lewis/PASSED) to
approve the twelve applications as presented to the board and instructed the
Clerk not to issue the Operator’s License to Santana L. Saldana until the
license fee is paid.
e.
Chairman Smith informed the board that he had been talking to Matt
Maroszek in regard to the control of
trees and brush in the road right of way by using Spray Master. It was recommended that the town spray half
of the roads one year and do the other half the following year. Chairman Smith is going to follow up on this
in regard to cost estimates on a time and material basis and setting up a time
frame for application of the spray.
f.
There was discussion in regard to making revisions to the town’s
Driveway/Culvert Ordinance which would address responsibility for road damage
when construction work is being done on private property especially during the
construction of a driveway, limiting driveways to one per parcel, changing the
maximum length of a driveway culvert from 35 feet to 36 feet and requiring
property owners to put “pans” on both ends of culverts as a safety measure in
case a vehicle ran into the road ditch and hit a culvert. A draft of these revisions will be an agenda
item for the August town board meeting.
Specific Town Board
Notice and Agenda for Upcoming Town Board Meeting: A meeting to open bids
for reconstruction of Elm Road and Maple Road is set for Tuesday, July 10, 2007
at 1:30 p.m. The next town board
meeting is scheduled for Monday, August 13, 2007 at 6:30 p.m. Agenda items suggested were (1) revisions to
the Driveway/Culvert Ordinance (2) an ordinance to require the payment of
delinquent taxes before issuance of any town permits/licenses and (3) new 911
numbers for the town to comply with an upcoming Shawano County Ordinance.
Voucher Listing/Payment
of Bills: MOTION (Powers/Lewis/PASSED) to approve payment of vouchers V-3723 through
V-3763.
Adjournment: MOTION (Lewis/Powers/PASSED) to adjourn
the meeting. The meeting was adjourned at 9:00 p.m.
