Call to
Order/Roll Call/Verification of Meeting Notice:
Chairman Smith called
the meeting to order at 6:30 p.m.. It
was verified with Clerk Powers that proper posting of the meeting had been
done. The agenda was posted on the
morning of August 9, 2008 and also faxed to the Shawano Leader on August 8th.
Approval or
Modification of Agenda: MOTION Lewis/(Powers/PASSED) to
approve the agenda as posted.
Approval of Prior Town Board
Minutes: MOTION (Powers/Lewis/PASSED) to approve the minutes of the regular town board meeting of July 14,
2008 and the public hearing on the Town of Angelica Comprehensive Plan held on
July 24, 2008.
Approval of Treasurer’s Monthly Report:
The Treasurer’s report was presented to the
board by Treasurer Matuszak showing balances as of July 31, 2008 of $29,235.37
at the Citizens Bank in Pulaski and $117,772.39 at the Premier Bank in
Pulaski. MOTION
(Powers/Lewis/PASSED) to approve the Treasurer’s report as presented.
Correspondence: Correspondence
reviewed was (1) two e-mails from town residents regarding weed laws in the
Wisconsin State Statutes and a compliment on the new flag-style 911 signs (2)
notice from the Wisconsin Department of Administration that the 2008
preliminary estimate of population for the town is 1,762 (3) copy of the county
Animal Waste Ordinance as changes were adopted on July 23, 2008 (4) copy of one
land use permit for property in the town (5) notices of meetings of the Shawano
County Board of Adjustment, Land Conservation and Planning, Development &
Zoning Committees (6) brochures from Wisconsin Extension regarding fall budget
and finance workshops and Wis Line Series for conducting elections (7) letter
from Kerber, Rose & Associates regarding services they have to offer.
Reports
from Town Officers: Supervisor Lewis reported a property owner on
Maple Road had a concern regarding the drop off to his driveway after
reconstruction of the road and he issued a driveway/culvert permit for one
temporary entrance to property on Elm Road and there would not be an entrance
from Hickory Road for the purpose of logging.
Supervisor Powers reported he had two new 911 signs to put up;
attendance at the Highway 29 upgrade meeting; he had picked up the one antique
chair that was refinished for the board room and that the county was in the
budgeting process at this time. Chairman
Smith reported (1) N.E.W. Paramedic did
not have a meeting in July because of the Frank Wicklacz funeral (2) the
Tri-County Fire Department Board of Directors had a short meeting to pay bills
and address the need for a consular’s help for some of the fire fighters (3) he
had received quotes for shouldering work on Elm Road and Maple Road and also
for widening Hill Drive (4) Carroll Road was regraded
and (5) asked the road maintenance person to fix a pot hole on Mile Drive.
Clerk Powers reported on
the publication by the Shawano Leader of a letter the town board had provided
to the operator of the Northwestern Pub with the provision that the ad showed
it was not prepared and paid for by the town.
The board was given a listing of town building permits issued since the
1st of the year and a copy of up to date ledger sheets pertaining to
Public Works – General and Public Works Construction.
Report
from Town Planning Committee Chairman: Town of Angelica Planning Committee Chairman Richard
Ferfecki was present and said he would hold any comments until various agenda
items came up.
Public Comments: MOTION (Lewis/Powers/PASSED) to
open the meeting up to public comments. Connie
Nischke had a question about the ad in the Shawano Leader regarding Northwestern Pub LLC. Elmer Kraning had a concern about shrubs at
the intersection of Church Drive and Cedar Road causing a vision problem. MOTION
(Powers/Lewis/PASSED) to close the public comment portion of the meeting.
Specific
Matters for Discussion and Possible Action by Town Board in Open Session:
New Business:
a.
A draft of Ordinance 8-11-08 Adoption of the Comprehensive
Plan of the Town of Angelica, Shawano County, Wisconsin was reviewed. Tim Reed, Director of the Shawano County
Planning & Zoning Department was
present and answered questions from the board regarding the comprehensive plan
and in particular regarding a possible ordinance requiring the knifing in of
liquid manure rather than spreading.
Reed also informed the board that the plan can be amended as needed and
recommended the plan be reviewed in a couple of years at the time when there is
a new census done. MOTION
(Powers/Lewis/PASSED UNANIMOUSLY) to approve Ordinance 8-11-08 as drafted
with the addition of a sentence on Page 32 under Chapter Two: Agricultural,
Natural, and Cultural Resources by adding the following to the first paragraph
under “Develop Animal Unit Density Standards:
“investigate the possibility of
passing an ordinance requiring the knifing in rather than spreading of liquid
manure in concentrated residential areas”. The town board also extended a special THANKS
to Richard Ferfecki, Chairman of the Planning Commission, for all the hours he
spent working on the town’s comprehensive plan.
b.
Patrick and Sandy Huben were
present in regard to their Request CU-2-08 for a conditional use permit for the
placement of fill in excess of 200 cubic yards on their property located at
W2210 County Road S. Patrick Huben
stated that he had exceeded the 200 cubic yards and has already hauled in 1,100
yards of fill. It is to be noted that
this will be an after-the-fact conditional use permit. Several concerns brought up were in regard to
the required 290 feet maximum front yard setback regulation under the A-290
Zone and interpretation that the back of the home had to be within this setback
regulation and also in regard to possible drainage problems caused by bringing
in the fill relating to ditches running through the Huben property and
neighboring property. It was pointed out
that the DNR was involved in Huben’s plan to bring fill in. MOTION
(Lewis/Powers/PASSED UNANIMOUSLY) to approve the after-the-fact Request
CU-2-08 for a conditional use permit for the placement of fill in excess of 200
cubic yards by Patrick and Sandy Huben. After more discussion regarding this request an additional
motion was made. MOTION (Smith/Lewis/PASSED UNANIMOUSLY) that the Hubens provide the
County PD&Z Committee with a survey having points to verify water drainage
on their property.
c. James Stocco,
SLS Construction Services, LLC, owning
property at W1545 County Road C, was
present as requested in a letter to him dated July 25, 2008. There
was lengthy discussion
regarding
how to proceed in requiring Stocco to bring the building at this location up to
code. Stocco did not have one clear plan
on what he plans to do with the building and mentioned using it
as a place for storage, having
living quarters and an office in the building, renting out the living quarters,
or turning it into a tavern. Stocco
offered to take off the old siding and box in the building. According to a revised Preliminary Consultation
done on 10-10-06 Stocco had started a variance request to construct a
second-story addition onto an existing garage with insufficient road setback and also a six-foot wide
wrap-around deck onto existing structure with insufficient road setback and also
the proposed deck and second story addition to be located within the visual
clearance triangle. MOTION (Smith/Lewis/PASSED UNANIMOUSLY) that James Stocco start the
variance process in order to be on the agenda for the September 2, 2008 Town of
Angelica Planning Commission meeting and the town board meeting scheduled for
September 8, 2008, to be followed by having his request taken before the
Shawano County Board of Adjustment. If
Stocco does not start to take the steps outlined above before the September 8,
2008 town board meeting, the town board will take further action. The clerk was instructed to send a certified
letter to James Stocco stating the town board’s decision.
Specific
Town Board Notice and Agenda for Upcoming Town Board Meeting: The
next town board meeting is scheduled for Monday, September 8, 2008. Possible agenda items are the Stocco
property at W1545 County Road C and appointment of a Krakow Sanitary District
Commissioner to replace retiring Commissioner James Lotter.
Voucher
Listing/Payment of Bills: MOTION (Lewis/Powers/PASSED) to approve payment of vouchers V-42211 through
V-4244.
Adjournment: MOTION (Lewis/Powers/PASSED) to adjourn
the meeting. The meeting was adjourned at 9:15 p.m.
