Monthly Meeting

December 8, 2008

Call to Order/Roll Call/Verification of Meeting Notice:  Chairman Smith called the meeting to order at 6:35 p.m..  It was verified with Clerk Powers that proper posting of the meeting had been done.  The agenda was posted on the afternoon of December 5, 2008 and also e-mailed to the Shawano Leader on Friday, December 5, 2008 by Clerk Powers.

 

Approval or Modification of Agenda:   MOTION (Powers/Lewis/PASSED) to approve the agenda as posted.

 

Approval of Prior Town Board Minutes:  MOTION (Lewis/Powers/PASSED) to approve the minutes of the regular town board meeting of November 10, 2008, the Budget Hearing, Special Town Meeting and Special Town Board Meeting held on November 20, 2008. 

 

Approval of Treasurer’s Monthly Report:  The Treasurer’s report was presented to the board by Treasurer Matuszak showing balances as of November 30, 2008 of $78,744.70 at the Citizens Bank in Pulaski and $16,965.06 at the Premier Bank in Pulaski.   MOTION (Powers/Lewis/PASSED) to approve the Treasurer’s report as presented.  

 

Correspondence:  Correspondence reviewed was (1) response of the Town of Angelica by Crivello-Carlson’s attorney to the Request for Admissions and Interrogatories of Acuity in Case of Mark Mroczynski v. Town of Angelica and the Written Discovery and Factual investigation in this case (2) request from the County Planner for a Town representative to the Zoning Advisory Committee (3) notice from WTA regarding a “Working Lands Workshop” (4) two county land-use permits issued for property in the Town of Angelica and (5) notices of meetings of the Shawano County Board of Adjustment, Land Conservation land PD&Z Committee meetings.

 

Reports from Town Officers:  Supervisor Lewis reported on a accident at the intersection of Green Valley Road and Deer Drive  and that he had checked to make sure the stop sign was in place and showed the board a notice by the City of Green Bay regarding depositing of snow and ice from private property on to City streets that was in the paper on December 3rd.

 

Supervisor Powers gave the board a copy of a letter written to the Shawano County Highway Commissioner by a town resident regarding the way the County was plowing the snow on STH-29 and how the town was doing plowing on the local roads; reported on attendance at a WTA Energy Seminar and that the County Highway Department has lined up all the salt they feel will be needed for this winter season.

 

Chairman Smith reported (1) the N.E.W. Para-Medic Squad board of directors did not have a meeting in December  (2) the Pulaski Tri-County Fire Department now has 41 members.  The Department had 72 runs to date compared to 82 last year with 13 runs for the Town of Angelica.  (3) MABAS is being pushed by Brown County but Oconto County and Shawano County are probably a year away from joining Brown County. (4) the Fire Department is planning to have two training meetings a month as recommended by the Roemer report (5) they checked out purchasing new turnout gear through a cooperative agreement with Brown County but the firemen did not approve the type of gear provided and they plan to look at other options in acquiring new turnout gear for the firemen.  There is $62,027.73 in the general account, $2,481.64 in the checking account, a CD of $2,050.17 for the camera account and a CD of $110,000.00 for the Vehicle Fund.  There will not be a meeting in December of the Fire Department Board of Directors.  (6) since the Highway Department employees have not approved the union contract, the County Highway Commissioner had asked whether the town wished to be billed at the old rate or wait with all billing until the contract has been approved.  Shawano County auditors had advised the Highway Department to add a one and one-half percent administrative charge to all work billed out to the town.  (7)  read a letter written to DA Greg Parker from a town resident on Beech Road that he had received a copy of which brought to the DA’s attention problems with two dogs leaving their property and killing his chickens and his being very concerned about the safety of his small children when these dogs come over to his property.

 

Clerk Powers reported on the difference in having the December newsletter done by a printing service and by doing it on the town copy machine which results in a saving of over one hundred fifty dollars.  Powers also reported to the board the difference in the tax statements of those people who appeared at Board of Review from 2007 to 2008, with three properties being higher for 2008 taxes and six properties being lower for 2008 taxes.

 

Report from Town Planning Committee Chairman:  Plan Commission Chairman Richard Ferfecki reported (1) that he had contacted the person in Krakow whose intent it was to process deer in a garage at this residence.  Ferfecki informed him that his property would have to be rezoned before he could start doing this and he was to check with Shawano County regarding this and then he would have to come before the Town Plan Commission and Town Board.  It was determined that he had not already processed any deer at this location.  (2) he had attended the meeting regarding the Shawano County Comprehensive Plan and that one town chairman had checked with an attorney and determined that if the plan was entitled “Shawano County Comprehensive Plan” rather than “Shawano County Comprehensive Plan Revised”, towns would not be able to get out of County Zoning, and (3) the neighboring Town of Green Valley doesn’t allow any culverts used as field entrances to be less than 35 feet and recommended that the Town of Angelica do the same.  Chairman Smith told Richard Ferfecki that the town board was appointing him as the Town of Angelica representative on the Shawano County Zoning Advisory  Committee and Ferfecki agreed to accept that position.

 

Public Comments:  MOTION (Lewis/Powers/PASSED) to open the meeting up to public comments.  Jeff O’Harrow gave the town board a recommendation by Shawano County Conservationist Ronald Ostrowski  regarding placement and size of culverts to be used when reconstructing Carroll Road and that the town should be working with the DNR regarding this.  Elmer Kraning told the board that the same two dogs referred to in the letter to DA Greg Parker come over to his woods.  MOTION (Lewis/Powers/PASSED) to close the Public Comment portion of the meeting.

 

Specific Matters for Discussion and Possible Action by Town Board in Open Session:

 

New Business: 

 

a.       Chairman Smith reported on the verbal quote of $55.00/hour for snowplowing in Zachow that he had received from Mel Nooyen of M & L Excavating and having gone over to the area to be plowed in Zachow with Nooyen.  A quote of $85.00/hour was received from Jeff Zernicke.  MOTION (Lewis/Powers/PASSED) to hire M & L Excavating to do the snowplowing on Northwestern Avenue in Zachow at the rate of $55.00 per hour.

 

b.      Chairman Smith showed the board a Boundary & Annexation Map he had received from the Department of Commerce with a request to review that map and then notify the Department if all the boundary lines were correct.  Upon review it was determined that the map correctly determined the boundaries of the town.

 

c.       An amendment to the Ambulance Service Agreement between the Town of Angelica, Town of Chase, Town of Lessor, Town of Maple Grove, Town of Pittsfield, Village of Pulaski and Gold Cross Ambulance Service, Inc. was reviewed in which it is agreed that the mileage rate established for ambulance service shall not exceed $11.50 per loaded mile and the municipalities agree to pay the Provider a subsidy of $212,798.09 for the calendar year 2009.  MOTION (Smith/Lewis/PASSED) to approve the amendment as presented.

 

d.      There was discussion regarding the special charge of $30.00 for installation of the new flag-style 911 numbers that was done in 2008 for all physical property numbers in the town.  The Clerk was unable to put the special charge on any tax exempt parcels as they do not receive a tax statement and the Clerk wanted to know whether or not there should be billing of this charge to those properties.  It was the general consensus to bill the special charge of $30.00 per 911 number to all the tax exempt properties with the exception of churches and cemeteries.

 

e.       Chairman Smith reported that he had made the appointments of members of the Plan Commission for the terms starting effective August 11, 2008 as required by the revision to the Town of Angelica Plan Commission Ordinance 7-9-07 as revised 11-10-08.  The first appointments will be for staggered terms with the term of office being three years after that.  Appointments were as follows:

            Chairman Richard Ferfecki for a three-year term.

Secretary Connie Nischke for a two-year term

Member James Bleick for a three-year term

Member Ron Hinkfuss for a two-year term

Member Barbara McKeefry for a one-year term

 

Specific Town Board Notice and Agenda for Upcoming Town Board Meeting:  The next town board meeting is scheduled for Monday, January 12, 2008.     

 

Voucher Listing/Payment of Bills:    MOTION (Lewis/Powers/PASSED) to approve payment of vouchers V-4363 through V-4391. 

 

Adjournment:  MOTION (Powers/Lewis/PASSED) to adjourn the meeting. The meeting was adjourned at 8:05 p.m.
