Call to
Order/Roll Call/Verification of Meeting Notice:
Chairman Smith called
the meeting to order at 6:30 p.m. Per
Clerk Powers the agenda was posted the afternoon of Saturday, August 7, 2010;
put on the town website and also e-mailed to the Shawano Leader on August 7th.
Approval or
Modification of Agenda: MOTION (Lewis/Van Asten/PASSED) to
approve the agenda as posted.
The
board deviated from the agenda to allow Wayne Murphy, candidate for the
position of Shawano County Sheriff, to speak to the board as a part of the
“Public Comments” portion of the meeting.
Approval of Prior Town Board
Minutes: MOTION (Van Asten/Lewis/PASSED) to approve the minutes of the regular town board meeting of July 12,
2010, July 26, 2010 informational meeting for property owners on Green Valley
Road, July 29, 2010 Board of Review and special Town Board Meeting of August 3,
2010.
Approval of Treasurer’s Monthly Report:
The Treasurer’s report was presented to the
board by Treasurer Matuszak showing balances as of July 31, 2010 of $17,258.42
at the Citizens Bank in Pulaski and $213,868.90 at the Premier Bank in
Pulaski. MOTION (Lewis/Van
Asten/PASSED) to approve the Treasurer’s report as presented.
Correspondence: Correspondence
reviewed was (1) filing of Notice of Motion and Motion for Summary Judgment and
Brief in Support of Motion for Summary Judgment to the Clerk of Circuit Court
in Shawano County regarding the Irene Banaszynski Case (2) copy of letter from
DNR to Daniel Domke regarding approval of project to discharge fill material
into wetlands at W289 S. Town Line Road (3) copies of two UDC permits for W1834
Beech Drive and N2762 Willow Road (4) copy of one land-use permit issued by
Shawano County Planning & Development for a detached garage at W798 Cuba
Drive (5) County Quarterly Notification of Relinquishments from Farmland
Preservation and (6) registration forms for 2010-2011 WisLine Teleconference
Series and 2010 Fall Budget and Finance Workshops.
Reports
from Town Officers: Supervisor Lewis reported (1) a street sign
at the corner of Elm and Town Hall is down (2) proposed costs from two firms
from Niagara and New London to pick up tires brought in at the town’s tire
drop-off day and (3) potential problems at the Town’s Tire Drop Off Day with a
request to bring large truck tires in.
Supervisor Van Asten
reported that he had cleaned out the culvert in front of the Erb property on
Wencel Street and there was very little water in the ditch after the last rain.
Chairman Smith reported
(1) the N.E.W. Para-Medic Squad did not have a board meeting in July (2) the
Fire Department presently has 43 members and additional members will be added
soon. For the year to date there have
been 53 runs with Angelica having 5 runs.
The Department still is being considered for receiving a $74,000.00 FEMA
Grant. The 50/50 grant from the DNR has
been approved. Shawano County has approved their MABAS agreement, Engine #1 has
experienced an electrical problem that was caused by incorrect installation of
a new generator. The fire department
will not be responsible for the cost of correcting this. The fire fighters presently are doing
ice/water rescue training, and the new addition to the fire department building
is almost completed. (3) two Town of
Angelica Planning Commission members’ term of office will end on August 11,
2010 and he is appointing Connie Nischke and Ronald Hinkfuss to another
three-year term. (4) he will be meeting
with the grader and Casey from Shawano County in regard to shouldering Green
Valley Road and Elm Road (5) a letter from Pulaski Police Chief Randal Dunford
was received in which the Police Chief commended all those volunteers who made
the Pulaski Polka Days a successful and safe event and especially thanked the
Pulaski Tri County Fire Department for all the help they gave the police department, and (6) asked
the road maintenance man to repair the pot holes on Mile Drive and Town Line
Road.
Clerk Powers reported on
(1) information in the town’s files regarding water drainage problems in Krakow
(2) reports given to the board on road work expenses through the month of
August and building permits issued year to date.
Report
from Town Planning Commission Chairman: Richard Ferfecki, Chairman of the Town of Angelica
Planning Commission, was present and reported on the Zoning Advisory Committee
meeting held on July 22, 2010 where the first half of the proposed new County
zoning ordinance was reviewed. The
current A-290 Zone will be incorporated into the new Open Lands &
Residential Zone contained in the proposed ordinance. Ferfecki reported to the board that there
will be more permitted uses rather than conditional uses in the new proposed
zoning ordinance.
Public Comments: MOTION (Van Asten/Lewis/PASSED) to open the meeting up for public comments. Elmer Kraning had a question in regard to maintenance costs at the Krakow Park. Ronald Krajewski had a concern about the weed, purple loosestrife, that is growing in the town road ditches and especially in the area of his property. Jim Mills commented that he believes whoever cut the grass in the road ditch on Green Valley Road near his property left the sickle up too high and the grass did not appear to be cut. MOTION (Lewis/Van Asten/PASSED) to close the public comment portion of the meeting.
Specific
Matters for Discussion and Possible Action by Town Board in Open Session:
New Business:
a. A
variance request by Dwayne Splan to allow an existing residence and associated out
building to be separated from the parent parcel where the residence will be in
excess of 290’ from the road right-of-way in the A-290 Zone was reviewed. The Town of Angelica Planning Commission
recommended approval of Variance Request V-3-10. It was stated that the banking industry has
recently had many changes and private mortgage insurance companies will now
only allow a maximum of 5 acres as a lot for a home. The existing buildings are now located on a
42.27 acre parcel. The home had been
built before the A-290 Zone was part of the Shawano County Zoning Code. Splan presented the board with a copy of a
survey done at the time he built the home, which survey showed the lot where
his home was built to be 4.388 acres.
However, this survey was never deeded or recorded. MOTION
(Lewis/Van Asten/PASSED UNANIMOUSLY) to recommend approval of V-3-10 to the
Shawano County Board of Adjustment.
b. Shawano
County recently adopted a new Land Division Ordinance and there was discussion
regarding how the town’s approval of Certified Survey Maps would be
handled. MOTION (Smith/Lewis/PASSED UNANIMOUSLY) that either the property
owner or surveyor come to the town board monthly meeting for approval of the
CSM. The board would approve the CSM by
motion and the Town of Angelica Planning Commission Chairman would sign off for
the town on the original Certified Survey Map.
c. MOTION (Van Asten/Lewis/PASSED
UNANIMOUSLY) to approve the CSM prepared by Surveyor Harry
Smith of Northeast Surveying, Inc. for the John H.; Jacobs III property at the
intersection of Carroll Road and Beech Drive.
d. MOTION (Lewis/Van Asten/PASSED
UNANIMOUSLY) to approve the CSM prepared by Surveyor Wayne R.
Reuter for the Donald J. and Carol Staszak property on Hilbert Street in
Zachow.
e. MOTION (Lewis/Van Asten/PASSED
UNANIMOUSLY) to approve the CSM prepared by Surveyor Wayne
R. Reuter for the Donald and Donna Robaidek, Jane Robaidek and Jean Robaidek
property on Town Hall Drive.
f. The
Federal Highway Administration is requiring a Plan of Action for all bridges
that have insufficient foundation information and the Shawano County Highway
Department will create this plan for the towns.
MOTION (Van Asten/Lewis/PASSED
UNANIMOUSLY) to request that the Shawano County Highway Department prepare
a Plan of Action for three bridges in the town located on Nichols Drive, Green
Valley Road and Elm Road.
g. Bids
for reconstruction of Green Valley Road approximately one mile south of its
intersection with Cuba Drive were received at a special meeting of the town
board on August 3, 2010. There is the
possibility that work on this project could not be started this year if the wet
conditions in that area do not improve. MOTION (Lewis/Van Asten/PASSED UNANIMOUSLY) to
accept the bid of the low bidder, Allan’s Excavating LLC, in the amount of
$47,780.00 for reconstruction work and 2,000 ton of ¾” crushed stone on
approximately one mile of Green Valley Road.
h. Chairman
Smith had received a request to provide garbage pickup in the town on a weekly
basis rather than the present every-other-week pickup. MOTION
(Lewis/Van Asten/PASSED UNANIMOUSLY) to leave the pickup schedule as it
presently is with every-other-week pickup of garbage.
i.
Applications for three operator’s licenses were reviewed. MOTION
(Van Asten/Lewis/PASSED UNANIMOUSLY) to grant operator’s licenses to
Chantel M. Birr, Candace M. Pautz and Rena Aprill for the license year ending
June 30, 2011.
j.
Specific
Town Board Notice and Agenda for Upcoming Town Board Meeting: The next town board meeting is scheduled for Monday,
September 13, 2010. The agenda item to
set a bank depository for the town’s general funds will be put on the September
13, 2010 town board meeting agenda.
Voucher
Listing/Payment of Bills: MOTION (Van Asten/Lewis/PASSED UNANIMOUSLY) to approve payment of vouchers V-5100 through
V-5125.
Adjournment: MOTION (Van Asten/Lewis/PASSED) to adjourn
the meeting. The meeting was adjourned at 9:00 p.m.
