Call to Order/Roll Call/Verification of Meeting Notice:  Chairman Smith called the meeting to order at 6:30 p.m.  Per Clerk Powers the agenda was posted the afternoon of Sunday, July 11, 2010; put on the town website and also e-mailed to the Shawano Leader on June 9th.

 

Approval or Modification of Agenda:   MOTION (Van Asten/Lewis/PASSED) to approve the agenda as posted.

 

Approval of Prior Town Board Minutes:  MOTION (Lewis/Van Asten/PASSED) to approve the minutes of the regular town board meeting of June 14, 2010.

   

Approval of Treasurer’s Monthly Report:  The Treasurer’s report was presented to the board by Treasurer Matuszak showing balances as of June 30, 2010 of $17,613.17 at the Citizens Bank in Pulaski and $263,662.33 at the Premier Bank in Pulaski.   MOTION (Lewis/Van Asten/PASSED) to approve the Treasurer’s report as presented.

 

Correspondence:  Correspondence reviewed was (1) CSM for 2 lots on Hilbert Street (2) copy of letter from DNR to Nighorn regarding placement of spoil material into wetlands (3) copy of UDC permit for W136 Fresa Court (4) copy of four land-use permits issued by Shawano County Planning & Development for two single family dwellings and two storage sheds (5) notice from DNR regarding Managed Forest Law payment (6) list of foreclosures of properties having tax liens from Shawano County (7) Krakow Sanitary District July newsletter and (8) invitation from Caroline Implement regarding information about John Deere commercial and contracting equipment.

 

Reports from Town Officers:  Supervisor Lewis reported (1) the end aprons are on the culvert recently installed on Green Valley Road (2)  a request from a property owner to allow them to place stone in the town road ditch and Lewis instructed the party to come to the town board meeting for permission (3) concern about grass not being cut on a property on State Highway 160, and (4) tires placed in road ditches.  Supervisor Van Asten reported on the Krakow Park pavilion toilets leaking.

 

Chairman Smith reported (1) at the N.E.W. Para-Medic Squad board meeting in June it was reported that there was $6,111.44 in the General Fund with $1,904.32 being in the 1st Responders Fund and $227.72 in the Junior EMS Fund.  There is a balance in the Equipment Fund of $9,182.71 with $4,280.90 being in the Building Maintenance Fund.  The High Yield Passbook savings fund at Citizens Federal Bank in Shawano is $65,562.67.  There were 42 runs in May with 32 being no transports and 3 runs for the Town of Angelica.  The Operating Income balance is $22,800.00 in the black (2) the Fire Department presently has 45 members.  For the year to date there have been 42 runs compared to 37 last year with Angelica having 5 runs.  The Department still has a chance of receiving a $74,000.00 FEMA Grant and are applying for grants to replace radios and pager needed because of the new short-wave radio system.  Shawano County is moving ahead on their MABAS agreement and the new addition to the fire department building should be completed soon   (3) paver patching has been done on Mile Drive and Hickory Drive and estimates have been received for shouldering work on three miles of Green Valley Road and two miles of Elm Road.  All the permits for reconstruction work on Green Valley Road have been received except one from the Army Corps., and  (4) a request has been received to allow a camper/campers to park overnight on the Krakow Park parking lot for the upcoming weekend.

 

Clerk Powers reported on (1) a request to have the agenda and minutes of the Town of Angelica Planning Commission put on the town’s website, and (2) reports given to the board on road work expenses through the month of July and building permits issued year to date.

 

Report from Town Planning Commission Chairman:  Richard Ferfecki, Chairman of the Town of Angelica Planning Commission, was present and reported that there is a Zoning Code Advisory Committee meeting scheduled for July 22 in the County Board Room at 7:00 p.m.  At this meeting there will be discussion of the preliminary draft of the revised County Zoning Ordinance and Ferfecki asked that everyone try to attend this meeting.

 

Public Comments:  MOTION (Lewis/Van Asten/PASSED) to open the meeting up for public comments.  Clair and LuAnn Erb  stated they had put in a culvert as requested by the town but the town has not corrected the drainage problem in that area and water is not draining away from their property and asked that this be taken care of.  Connie Nischke had a question as to whether or not the Pulaski Tri-County Fire Department had saws capable of cutting corrugated steel.  Chairman Smith informed her that the Department had two saws with carbide blades that were used in the grain bin incident in Zachow.  MOTION (Van Asten/Lewis/PASSED) to close the public comment portion of the meeting.

 

Specific Matters for Discussion and Possible Action by Town Board in Open Session: 

 

New Business:

 

a.       Shawano County Zoning Administrator Robert Jacobson was present.  He provided the board and the Planning Commission with a summary of major changes in the new Shawano County Land Division Ordinance 3-10 which replaces the 1970 Shawano County Subdivision Ordinance.  There was discussion regarding the bond requirement for operators of non-metallic mining pits and the possibility of this requirement being a conditional use put on the conditional-use permit issued by Shawano County or being a requirement before the operator appears before the Town of Angelica Planning Commission’s hearing.  Jacobson informed the board that this could be enforced at the county level by placing the bond requirement as a condition on the conditional-use permit if the town wished to do this.

 

There was also discussion regarding interpretation of the A-290 Zone and this zone having a minimum depth requirement for a lot to be at least 290 feet deep.  This is not presently included in the Shawano County A-290 zone but the town could create its own ordinance having this requirement.  Jacobson gave the town copies of zoning maps that will be included in the County’s Comprehensive Plan.  The maps were the present Town of Angelica Zoning, Future Land Use and Zoning Districts.

 

b.      Greg Manci’s conditional use request application, CU-3-10, to operate a non-metallic mining pit on 2.6 acres located at W525 Townline Road was reviewed.  Planning Commission Chairman Richie Ferfecki informed the board that the Planning Commission had recommended approval of this request with 14 recommended conditions being on the permit.  The conditions included a bond of $5,000.00 for road repair if the road was damaged and the requirement of having a Land Reclamation Plan.  MOTION (Lewis/Van Asten/PASSED UNANIMOUSLY) to recommend to the Shawano County Planning & Zoning Committee that approval be given to CU-3-10 with the fourteen recommended conditions.

 

c.       A variance request by John Jacobs III for a dwelling to be 610’ from the right-of-way of Beech Drive where 290’ is the maximum front yard setback in the A-290 Zone was reviewed.  Jacobs wishes to survey out five acres of a forty-acre parcel as a separate parcel where his new home will be located.  The Town of Angelica Planning Commission recommended approval of Variance Request V-1-10 inasmuch as there is an existing mound system, drilled well and electric service in this area where the house burned and the proposed home location is currently not being farmed.  The Commission also requested that the driveway be 15’ in width in order that fire and rescue would have access.  MOTION (     Van Asten/Lewis/PASSED UNANIMOUSLY) to recommend approval of V-1-10 to the Shawano County Board of Adjustment.  Jacobs agreed to have the existing driveway conform to the town’s ordinance which requires a driveway to be 25 feet at road right-of-way and first 25 feet from that point ~ then can taper down to 15 feet.  The ordinance also requires a driveway of over 500 feet in length to provide a turn-around in the form of a T which is 25 feet deep and 15 feet wide or other adequate turn-around as approved by the Town Board.

 

d.      A variance request by Doug Splan to allow an existing residence and associated out building to be separated from the parent parcel where the residence will be in excess of 290’ from the road right-of-way in the A-290 Zone was reviewed.  The Town of Angelica Planning Commission recommended approval of Variance Request V-2-10.  It was stated that the banking industry has recently had many changes and private mortgage insurance companies will now only allow a maximum of 5 acres as a lot for a home.  The existing buildings are now located on a  forty-acre parcel.  MOTION (Lewis/Van Asten/PASSED UNANIMOUSLY) to recommend approval of V-2-10 to the Shawano County Board of Adjustment.

 

e.       Shawano County’s Subdivision Ordinance, which replaced the 1970 Shawano County Subdivision Ordinance, was reviewed earlier in this meeting with Robert Jacobson and the Town of Angelica Planning Commission members.

 

f.       MOTION (Van Asten/Lewis/PASSED UNANIMOUSLY) to grant an operator’s license to Jackie S. Wawiorka for the license year ending June 30, 2011.

 

g.      The agenda item to set a bank depository for the town’s general funds will be put on the August 9, 2010 town board meeting agenda. 

 

h.      There was discussion regarding the town giving a donation to the Supporters of Shawano K-9 non-profit organization.  A request was received in the latter part of 2009 asking for donations for the expense of equipment, training and supplies needed to maintain the two dogs that are working with the Shawano County Sheriff’s Department.  One of these dogs is located in Krakow.  It was the general consensus to give S.O.S. K-9, Inc. a $250.00 donation next month and put another $250.00 donation in the 2011 budget.  A $250.00 donation will be put on the voucher listing for approval at the August 9, 2010 town board meeting.

 

 

Specific Town Board Notice and Agenda for Upcoming Town Board Meeting:  The next town board meeting is scheduled for Monday, August 9, 2010.  

 

Voucher Listing/Payment of Bills:  MOTION (Lewis/Van Asten/PASSED) to approve payment of vouchers V-5069 through V-5099.  

 

Adjournment:  MOTION (Van Asten/Smith/PASSED) to adjourn the meeting. The meeting was adjourned at 9:05 p.m.
