Call to Order/Roll Call/Verification of Meeting Notice:  Chairman Smith called the meeting to order at 6:30 p.m.  Per Clerk Powers the agenda was posted the afternoon of Friday, September 10, 2010; put on the town website and also e-mailed to the Shawano Leader on September 10th.

 

Approval or Modification of Agenda:   MOTION (Van Asten/Lewis/PASSED) to approve the agenda as posted.

 

Approval of Prior Town Board Minutes:  MOTION (Lewis/Van Asten/PASSED) to approve the minutes of the regular town board meeting of August 9, 2010.

   

Approval of Treasurer’s Monthly Report:  The Treasurer’s report was presented to the board by Treasurer Matuszak showing balances as of August 31, 2010 of $158,834.31 at the Citizens Bank in Pulaski and $184,039.14 at the Premier Bank in Pulaski.   MOTION (Lewis/Van Asten/PASSED) to approve the Treasurer’s report as presented.

 

Correspondence:  Correspondence reviewed was (1) 2010 Equalization Report from the Wisconsin D.O.R.  (2) preliminary estimate of January 1, 2010 population of the town from Wisconsin D.O.A. of 1,783 (3)  copies of Shawano County Ordinances 8-10 and 9-10 (4) County notice of proposed text and service fee schedule for the Planning, Development and Zoning Department (5) copies of three land-use permits issued by the County (6) notice from the Public Service Commission regarding proposed Wind Siting rules (7) notices from the Public Service Commission regarding application for a Biomass-Fired, Cogeneration Facility in Marathon County (8) copies of Angelica Hillside Cemetery Association bank statements, and (9) August 2010 D.O.A. Local Government Report.

 

Reports from Town Officers:  Supervisor Lewis reported on issuance of a field entrance permit to property on Green Valley Road with a question of where to place the entrance because of the land being low and also the size of the culvert needed.  Lewis and Smith will look at the area together to determine driveway placement.  Supervisor Van Asten reported that he had just recently received a complaint about a mail box being hit by a snow plow; the black top breaking up on Nichols Drive going up the hill; cleaning out the culvert in Krakow near the Erb property, and having a question as to whether or not there would be blacktop put down next to the town hall entrance.    

 

Chairman Smith reported (1) the N.E.W. Para-Medic Squad has $9,785.64 in its General Fund with $5,578.07 being for the 1st Responders and $227.72 for the Jr. EMT’s;  $9, 082.04 in the Equipment Fund with $4,177.90 being in the Building Maintenance Fund; and a High Yield Passbook savings fund at Citizens Federal Bank in Shawano in the amount of $65,814.72.  In July there were 47 runs with 18 no transports and 5 runs were for the Town of Angelica.  The Operating Balance is $18,406.00 in the black. (2) the Fire Department presently has 43 members with 2 being on medical leave and 1 on administrative leave.  For the year to date there have been 58 runs with Angelica having 9 runs.  The Department still is being considered for receiving a $74,000.00 FEMA Grant.  The Fire Department recently had RIT training with Bonduel and other surrounding communities.  There will be upcoming changes in the code for fire inspections.  Cost estimates for the new communications system and having all radios on the same frequency were $70,970.00 for the Fire Department and $75,608.00 for the N.E.W. Para-Medic Squad.  It has been proposed to take out three-year bonding for this project.  Some interest has been shown for purchasing the old ladder truck.  (3)  shouldering on Green Valley Road and Elm Road has been done; had a meeting with the County regarding the problem with stone on the road at the intersection of Deer Drive and Green Valley Road and it is proposed to put in a cement curb and bring the blacktop up to it on the southeast corner of this intersection.  Blacktopping is completed on Carroll Road and Town Line Road with the shouldering completed on Carroll and three-quarters done on Town Line.  The contractor has started reconstruction work on Green Valley and it is planned to grind the blacktop the week of the 20th.   (4) some ditching work will be done near the intersection of Deer Drive and Maple Road (5) he had met with the County Engineer to look at ways to solve the drainage problem in Krakow on Wencel and Julius Streets with either a 8” tile or doing a shallow ditch to move water east to the big drainage ditch.  A meeting will be held with property owners before any decisions are made, and (6) asked the Road Maintenance person to check the potholes on Green Valley Road, Town Line Road and Hof Street 

 

Clerk Powers reported on (1) information requested by Crivello-Carlson regarding the Banaszynski claim and (2) reports given to the board on road work expenses and building permits issued year to date.

 

Report from Town Planning Commission Chairman:  Richard Ferfecki, Chairman of the Town of Angelica Planning Commission, was present and reported on the last Zoning Advisory Committee meeting held on August 26, 2010 where the second half of the proposed new County zoning ordinance was reviewed.  New sign regulations are proposed.  In 2012 the AG-1 and AG-2 zones will be called FP-1 and FP-2 but there are no changes being made. Density in the Farmland Preservation zones will be 1 home to 20 acres.  The current A-290 Zone will be incorporated into the new Open Lands & Residential Zone and will have a density requirement of 1 home to 10 acres.  The County will now have requirements in regard to number of parking spaces and lighting for new businesses but any landscaping requirements would be up to the towns.  A site assessment check list will have to be done before the County will issue permits for commercial or business properties.  Non-conforming buildings can be reconstructed or remodeled as long as the building’s footprint remains the same. When any rezoning is requested for properties in the town the Town Clerk has to notify the County Zoning Administrator or another option would be to provide a certified copy of a town board resolution regarding approval or disapproval based on the town’s adopted comprehensive plan that would be filed with the Shawano County Planning & Zoning Committee thirty days prior to a scheduled meeting of that committee.  Ferfecki also brought up concerns regarding the zoning of the Gene Reyment property if it is a salvage yard and the condition of the old fireworks stand on County Road C in Angelica.

 

The town had requested that Attorney Richard Lubinski research and draft two ordinances for the town regarding A-290 Zoning and Animal Waste.  Chairman Smith had the Clerk read a letter from Attorney Richard Lubinski regarding these ordinances.  In regard to A-290 Zoning and the town requiring a minimum depth of 290 feet in each lot and a density requirement of not more than one residence per 10 acres; because the town is under County Zoning the town cannot adopt its own zoning ordinance unless it wants to take control of the zoning itself.  The town could create a sub-division ordinance which would lay out rules for lot sizes and would require a full set of ordinances as well and would have to be enforced by the town.  In regard to animal waste and requiring that liquid manure be knifed into soil within one-half mile of residential development; Attorney Lubinski informed the town that the town is not able to add any additional restrictions to the State law without following a set of procedures to get the additional restrictions approved by the State and that the Shawano County Animal Waste Ordinance is simply a restatement of the State law.  A suggestion Attorney Lubinski had was to address any noxious odor problems by using the County’s Nuisance Ordinance if this is covered in that ordinance. 

 

Enforcement of town ordinances was discussed.  Chairman Smith mentioned that the Town of Pittsfield was interested in joining with the Village of Pulaski in having a joint Municipal Court and perhaps the Town of Angelica could also look into this.

 

Public Comments:  MOTION (Lewis/Van Asten/PASSED) to open the meeting up for public comments.  Ron Banaszynski asked about how the tire drop-off day turned out.  Elmer Kraning told the board he had bundled up the cardboard from the storage garage and put it out for pickup by Waste Management; which they did.  Kraning also had concerns about finishing the grass cutting in road ditches and putting up barricades and a sign on Town Line Road where there was drop-off in the shoulder of the road.  Lisa Matuszak mentioned that a resident had asked she pass on to the town board that she and another resident thought the fairest way in putting out garbage for pickup was with the use of garbage stickers rather than having a flat fee put on the tax statements and discontinuing the use of stickers.  Greg Van Asten inquired about the different ambulance at N.E.W. and Chairman Smith stated it was a Gold Cross van that was being used while repairs were being made on one of the N.E.W. ambulances.  Van Asten also inquired about County Rescue responding to an emergency call rather than N.E.W.  MOTION (Van Asten/Lewis/PASSED) to close the public comment portion of the meeting.

 

Specific Matters for Discussion and Possible Action by Town Board in Open Session: 

 

New Business:

 

a.       An application for a Class “A” Beer License from Tedd Nadler, Nadler Auto Service, to sell beer from a convenience store at W2418 Main Street in Zachow was reviewed by the board.  MOTION (Van Asten/Lewis/PASSED UNANIMOUSLY) to approve the granting of a Class “A” Beer License to Tedd Nadler for the license year ending June 30, 2011.

 

b.      Applications for two operator’s licenses were reviewed.  MOTION (Van Asten/Lewis/PASSED UNANIMOUSLY) to grant operator’s licenses to Amanda Schmoll and Melissa M. Hagel for the license year ending June 30, 2011.

 

c.       Treasurer Matuszak gave the board proposals from Premier Community Bank, North Shore Bank and Citizens Bank regarding depositories for the town’s general funds in a checking account and depositing tax money funds in a separate savings account.  There was discussion regarding service provided, fees and interest rates.  One area of concern was the amount and way the banks provide FDIC and State insurance especially for the Tax Money Account.  It was the general consensus to have a representative from each bank come to the next three town board meetings, one at a time, and answer the boards’ questions regarding the different accounts.

 

d.      There was discussion regarding three properties in Zachow which are presently zoned residential and the use of these properties in the past and present have been commercial uses.  All three property owners wish to continue with commercial use of their properties.  MOTION (Lewis/Van Asten/PASSED UNANIMOUSLY) to request to have Shawano County correct zoning from residential to service commercial on Parcels 004-90150-0030 (Tedd & Rhonda Nadler), 004-90150-0001 (Donald J. & Carol Staszak)  and 004-90150-0110 (Albert Radtke Inc.) to reflect the actual commercial uses of these properties.

 

Specific Town Board Notice and Agenda for Upcoming Town Board Meeting:  The next town board meeting is scheduled for Monday, October 11, 2010.  Having a representative from one of the Pulaski banks attend the town board meeting to provide the board with information regarding depositories for the town’s general funds and tax money funds will be put on the October 11, 2010 town board meeting agenda.  

 

Voucher Listing/Payment of Bills:  MOTION (Van Asten/Lewis/PASSED UNANIMOUSLY) to approve payment of vouchers V-5126 through V-5162.
